Regular Business - Public Hearing Items <br /> <br /> <br /> Resolution No. 14, Series 2004, St. Louis Parish and Commercial Park – General <br /> <br />Development Plan <br />, a request to rezone three properties from the current zoning of <br />Agriculture (A) to Planned Community Zone District (PCZD) for a mix of religious, <br />school and commercial uses. Case #03-027-ZN. <br /> <br /> <br />Case Manger: Paul Wood, Planning Director <br /> <br /> <br />Applicant: St. Louis Parish <br /> <br /> <br /> <br />Owners: Archdioceses of Denver, Owens and Games <br /> <br /> <br /> <br />Representative: Brian Rick, Rick and Associates <br /> <br />Conflict of Interest and Disclosure: Lipton reported that Kalish is excused. <br /> <br />Public Notice Certification: Wood reported this is a continued item from the May 11, 2004 <br />Planning Commission Public Hearing. The notice was re-posted in City Hall on May 21 for the <br />June 8 meeting. <br /> <br />Staff Report of Facts and Issues: Wood presented a brief background of the request and then <br />summarized the new information related to a revised traffic impact study for St. Louis Parish <br />prepared by LSC Transportation Consultants, dated May 25,2004. <br />Study is for 2004, 2010 and 2025. <br /> <br /> <br />Last study done in 2001 reported 17,000 trips / day at the intersection of Dillon and S. <br /> <br /> <br />th <br />96 St. with a Level of Service (LOS) at ‘C’. <br />The new study for 2004 reports 32,500 trips / day at ‘C’ with no site improvements. S. <br /> <br /> <br />th <br />96 St. picks up the majority of the trip increases. <br />In 2010 the LOS will continue at ‘C’ with or without site improvements. <br /> <br /> <br />Public Works and Engineering comments addressed the turning movements on Dillon <br /> <br /> <br />th <br />and S. 96 St. The full movement that is requested by the applicant is not supported by <br />Public Works and Engineering, however the full turning movement at the mid-point on <br />th <br />96 St. is supported, as well as the ¾ turning movement at the north end of the site. <br />Wood concluded by stating that Staff recommends approval with 4 conditions. <br /> <br />Commission Questions: <br />McAvinew: <br />Requested owner clarification because in one section of the staff report it references <br />St. Louis Parish and in another section it references the Denver Archdiocese. <br />Wood: The Denver Archdiocese is the owner. <br /> <br />Deborski, McDermott and McAvinew: <br />Continued with a discussion and clarification of a height <br />restriction and / or exemptions and what they could apply to, and the church steeple exemption. <br />Wood: Stated that the application is subject to the Commercial Development Design Standards <br />and Guidelines (CDDSG) which has a 35’ height limit. However, a church steeple is exempt <br />from that height limit. A 35’ height would permit a 3-story building. Before staff can support any <br />exemption from the CDDSG, building elevations would need to be submitted for review as part <br />of a PUD application <br /> <br />Lipton: <br />Discussed the use of a Planned Community Zoning District (PCZD) and the requirement <br />for a General Development Plan (GDP). <br />2 <br /> <br /> <br />
