<br /> <br /> <br />Commission Questions: <br />Lipton requested questions from Commissioners to staff. <br /> <br />Commissioner Michael Deborski asked if the City without the ownership of the property being <br />established would have installed a water tap. Johnstone stated that the City has no record of the <br />installation of the water and sewer taps dating back to 1954 or of what may have been standard <br />City practices at that time. <br /> <br />Commissioner Susan Loo requested clarification of other documents that came to the City’s <br />attention. Johnstone referenced a building permit for an accessory structure approved a few <br />years ago. The ILC used for that building permit did not include the ROW. <br /> <br />Commissioner Loo asked if the City had been aware that the family had been using the area for <br />apparently a number of years. Johnstone stated he could not confirm what knowledge the City <br />had of the use of the ROW by the family. <br /> <br />Chairman Lipton asked what does the City have that documents the ROW. Johnstone stated the <br />record of Plat for the Murphy Place Subdivision that was platted in 1907. <br /> <br />Commissioner Bill McDermott requested a clarification of the 2 units / structures that the family <br />is paying taxes on. Johnstone stated that the applicant would need to clarify that during their <br />presentation. He stated that his knowledge of that issue was that the structures in the ROW have <br />appeared on Assessor’s records, but the actual land has not. <br /> <br />Chairman Lipton asked for other Commissioner questions. None heard. <br /> <br />Applicant Presentation: <br />Chairman Lipton asked for the applicant presentation. <br /> <br />Denise Ehrmann, 221 Front St. presented a new letter from a neighbor, Pauline Reich, in support <br />of the ROW vacation. Ms. Ehrmann reviewed for the Planning Commission a packet of <br />information that the family had provided for their meeting packets. She explained the use of the <br />small house, first as a residence then as a storage unit. She spent the remainder of her <br />presentation discussion conversations she had had with the Assessor’s Office and the additional <br />taxes they had been paying. <br /> <br />Commission Questions of Applicant: <br />Chairman Lipton asked for questions from the Commissioners to the applicant. <br /> <br />Commissioner Deborski asked who maintains the property. Ms. Ehrmann replied that her family <br />had been maintaining the property since 1934 when her grandfather purchased it from Mr. <br />Murphy. <br /> <br />3 <br /> <br /> <br />
