Case #05-004-FP. (Staff requests continuance to May 12, <br />2005.) <br /> <br /> <br />Case Manager: Kenneth Johnstone, Principal Planner <br /> <br /> <br />Owner: The Nautilus Group, Inc., Wayne Belio <br /> <br /> <br />Applicant and Representative: The Nautilus Group, Inc., Holden J. Bank <br />Staff reviewed the request for continuance. <br />Pritchard moved and Deborski seconded a motion for continuance of Case #05-004-FP to <br />the May 12, 2005 Planning Commission Public Hearing. Motion passed by unanimous <br />voice vote. <br />Regular Business – Public Hearing Items <br /> <br />Resolution No. 08, Series 2005, Empire Road Subdivision <br />, a final <br />subdivision plat to create two lots with Lot 1 to be 2.66-acres and Lot 2 to be <br />2.96-acres at 1301 and 1303 Empire Rd, located on the north side of Empire <br />Rd. between S.H. 42 and the City Shops facility. Case #05-001-FS. (continued <br />from March 10, 2005) <br /> <br /> <br />Case Manager: Kenneth Johnstone, Principal Planner <br /> <br /> <br />Applicant, Owner and Representative: J.M.T. Properties, Jamie Hess <br />Public Notice Verification: Staff reported the original notice was published in the Daily <br />Camera on February 27, 2005 and mailed to the surrounding property owners on February <br />25, 2005. This was a continued business item from the March 10, 2005 public hearing <br />therefore the notice was reposted per the public notice notification requirements. <br />Conflict of Interest and Disclosure: None. <br />Staff Report of Facts and Issues: <br />Johnstone provided the following summary: <br /> <br /> <br />An application for a two-lot subdivision on the north side of Empire Road, just <br />east of SH 42. The property is approximately 5.6 acres and is zoned Industrial. <br />There is no planned unit development (PUD) being proposed for actual <br />development at this time. Any development of the property would be subject to <br />review through a standard PUD process. <br /> <br /> <br />The Planning Commission approved the preliminary subdivision plat at the <br />January 13, 2005 meeting, with 6 conditions of approval that would be addressed <br />through the final plat process. <br /> <br /> <br />The property was annexed in 1986 as the Trousil Annexation and had several <br />conditions in the annexation agreement that need to be properly reflected in the <br />final subdivision plat and associated subdivision agreement. <br /> <br /> <br />Standard language related to easement and right of way dedications was included <br />in the Annexation Agreement, as was standard language regarding the need to <br />install necessary public improvements. While the subdivision dedicates additional <br />right of way and easements and because there is not an actual development <br /> <br />
