All <br />inoperable or wrecked vehicles shall be parked indoors or in the <br />screened impound areas. <br /> <br />2)On street parking or storage of employee or patron vehicles is <br />prohibited. <br /> <br />3)The issuance of Phase 2 building permits shall be conditional upon <br />unqualified continuance and availability of adequate off-street <br />parking. Any additional off-street parking area acquired by lease <br />agreement shall be within 300 feet of the building. <br />The current business operations are in violation of the above conditions. <br /> <br /> <br />Staff submitted a review of the property at the March 2005 meeting at the <br /> <br /> <br />request of the Commission. The intent was to make a determination if the <br />Commission would call up the PUD and SRU based upon noncompliance <br />with the above stated PUD conditions. The PUD and SRU was not called <br />up by the Commission. <br />Preliminary PUD was approved July 13, 2004 by Resolution 16, Series 2004 with <br /> <br /> <br />eleven conditions of approval. The staff review of the final PUD and SRU <br />concluded that two of conditions have not been addressed and will be <br />recommended as conditions of approval for the final. <br />Right-of-way / access and circulation summary: <br /> <br /> <br />The City has initiated a full design study of HWY 42 which will review <br /> <br /> <br />the ROW needs for HWY 42 between Pine St. and Pascal. Based on <br />preliminary findings the City is requesting an additional ROW dedication <br />of 15’ on HWY 42. <br />The engineering and planning divisions are requesting the applicant to <br /> <br /> <br />shift the location of the access drive into the property from Cannon Circle <br />35 feet to the west. This will provide the separation needed between the <br />access drive and HWY 42, improve the traffic circulation to and from the <br />site and eliminate the ‘S’ turning movement from Cannon Circle to the <br />service bay between the two service structures. <br />Parking summary: <br /> <br /> <br />Proposed build out yields a parking requirement of 42 spaces. <br /> <br /> <br />The PUD reflects 24 surface parking. Seventeen of those spaces are <br /> <br /> <br />credited toward meeting the required on-site requirement. <br />The 15 spaces in the ‘vehicle stacker’ or lift system may function for an <br /> <br /> <br />impound area, but in Staff’s opinion are not eligible to be credited toward <br />the required parking ratio. <br />Section 17.20.100 of the Louisville Municipal Code states that no required <br /> <br /> <br />on-site space shall be used for storage or parking of inoperable vehicles. <br />The position of staff, that the project does not demonstrate that adequate <br /> <br /> <br />off street parking has been provided, is based on: <br />Longer turnaround times associated with auto body operations <br /> <br /> <br />The heavy reliance on interior parking to meet the required <br /> <br /> <br />parking ratio; and <br /> <br />
