City Council <br />Study Session Summary <br />July 22, 2014 <br />Page 2 of 2 <br /> <br />Council members and others present were in favor of a Boards and Commissions <br />handbook. Council would like Boards to review their mission statements periodically. <br />Update/Discussion Review Quasi-Judicial Process, Rules and Regulations: <br />City Attorney Sam Light provided a refresher and review for City Council on what it <br />means to act in a quasi-judicial capacity. The key characteristics of quasi-judicial <br />actions are notice and a hearing before action is taken, and a decision that results from <br />applying the law to the facts. In quasi-judicial matters the procedure by which a <br />decision is arrived at can be more important for a legal and liability standpoint than the <br />substance of the decision. <br />Much like a judicial proceeding, no party has a right to a private audience with the <br />quasi-judge regarding a quasi-judicial matter. All discussions must take place during <br />the hearing. Light recommends not read emails that pertain to quasi-judicial matters <br />and send a standard response. <br />City Manager <br />City Manager Malcolm Fleming reviewed the Advanced Agenda. He also gave an <br />update on the following: <br /> Landscapes Unlimited has the pond liner done and the sprinkler system <br />activated. Power line for the booster pump is still to be installed. Golf Course <br />reconstruction progress has been steady. <br /> Progress with FEMA has been slow. <br /> Council member Keany suggested highlighting quasi-judicial items on the <br />Advanced Agenda. <br /> There was discussion of future agenda items and Executive Sessions. <br />Adjourn 9:31 pm <br />Submitted by Dawn Burgess <br />July 23, 2014 <br />
