Motion passed by a 7 - 0 vote.

RESOLUTION NO. 59, SERIES 1996 - APPROVING A FINAL SUBDMSION PLAT
FOR BOULDER VALLEY SCHOOL DISTRICT

Tom Phare, Public Works Director, stated that last week an issue concerning the drainage easement
came up. There are a number of areas being dedicated to the City for drainage easements. It will be
very expensive to repair these facilities in the future. Orr had told him that if the City would have a
presence there, it would be a total presence, both maintenance and replacement. Phare told Orr that
the City would do the day-to-day maintenance, but was not comfortable with the fiscal responsibility
to replace all of the storm drainage facilities. Orr stated that if that was the case, they would ante up
for that, but they would like to have the easements eliminated from the plat, so they would not
incumber the parcel. He explained that the City would be relying on a prescriptive easement, the
drainage reports, and other documents to support the City's right, which the School District had no
issue with, to drain the City's facilities through the campus. He recommended that the language in
the plat be modified to eliminate the dedication of a drainage easement to the City.

Davidson called for Council questions or motions.

3
