WHEREAS, the City Council finds that prohibiting the use of electronic smoking <br />devices in public places and meetings will protect the public health, safety, comfort and general <br />welfare; and <br />WHEREAS, the City Council desires to extend its smoking ban to prohibit smoking in <br />entryways of public places to align the City's ordinance with state statute; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br />Section 1. Section 8.56.010 of the Louisville Municipal Code is hereby by amended <br />to read as follows (words to be added are underlined; words to be deleted are stricken through): <br />Sec. 8.56.010. Intent; effective date. <br />In order to protect the public health, safety, comfort and general welfare, <br />and because tobacco -and smokeing is a positive danger to health and because, it is <br />the declared purpose of this chapter to prohibit smoking, including using <br />electronic smoking devices, in areas which are used by or open to the public <br />unless such areas are permissible smoking areas pursuant to this chapter. The <br />provision of this chapter are effective October 8, 2002. <br />Section 2. Section 8.56.020 of the Louisville Municipal Code is hereby by amended <br />by the addition and amendment of the following definitions (words to be added are underlined; <br />words to be deleted are stricken through): <br />Sec. 8.56.020. Definitions. <br />For the purposes of this chapter the following terms, phrases, words, and <br />their derivatives shall have the meanings given in this section, except where the <br />context clearly requires a different meaning: <br />Electronic smoking device means an electronic or battery- operated device <br />that provides a vapor of nicotine or any other substance and the use or inhalation <br />of which simulates smoking. The term shall include every variation of such <br />device, whether manufactured, distributed, marketed, or sold as an e- cigarette, e- <br />cigar, e- cigarillo, e -pipe or under any other product name or descriptor. <br />Entryway means the outside of the front or main doorway leading into a <br />public place, the outside of any other doorway leading into such public place that <br />is accessible to the public, and the area of public or private property within fifteen <br />feet (15') outside the doorway. <br />Retail electronic smoking device store means a retail store devoted primarily <br />to the sale of electronic smoking devices, and in which the sale of other products is <br />Ordinance No. 1669, Series 2014 <br />Page2 of 5 <br />
