WHEREAS, the City Council finds that prohibiting the use of electronic smoking devices in public places and meetings will protect the public health, safety, comfort and general welfare; and WHEREAS, the City Council desires to extend its smoking ban to prohibit smoking in entryways of public places to align the City's ordinance with state statute; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. Section 8.56.010 of the Louisville Municipal Code is hereby by amended to read as follows (words to be added are underlined; words to be deleted are stricken through): Sec. 8.56.010. Intent; effective date. In order to protect the public health, safety, comfort and general welfare, and because tobacco -and smokeing is a positive danger to health and because, it is the declared purpose of this chapter to prohibit smoking, including using electronic smoking devices, in areas which are used by or open to the public unless such areas are permissible smoking areas pursuant to this chapter. The provision of this chapter are effective October 8, 2002. Section 2. Section 8.56.020 of the Louisville Municipal Code is hereby by amended by the addition and amendment of the following definitions (words to be added are underlined; words to be deleted are stricken through): Sec. 8.56.020. Definitions. For the purposes of this chapter the following terms, phrases, words, and their derivatives shall have the meanings given in this section, except where the context clearly requires a different meaning: Electronic smoking device means an electronic or battery- operated device that provides a vapor of nicotine or any other substance and the use or inhalation of which simulates smoking. The term shall include every variation of such device, whether manufactured, distributed, marketed, or sold as an e- cigarette, e- cigar, e- cigarillo, e -pipe or under any other product name or descriptor. Entryway means the outside of the front or main doorway leading into a public place, the outside of any other doorway leading into such public place that is accessible to the public, and the area of public or private property within fifteen feet (15') outside the doorway. Retail electronic smoking device store means a retail store devoted primarily to the sale of electronic smoking devices, and in which the sale of other products is Ordinance No. 1669, Series 2014 Page2 of 5
