Sec. 8.56.050. Responsibilities of proprietors.
<br />A. No owner, lessee, principal manager, or person in charge of a
<br />public place, entryway, common area, or outdoor eating area shall, with respect to
<br />such place or area, fail to:

<br />Section 5. Section 8.52.020 of the Louisville Municipal Code is hereby by amended
<br />to read as follows (words to be added are underlined; words to be deleted are stricken through):
<br />Sec. 8.52.020. Definitions.
<br />For the purposes of this chapter, the following definitions shall apply:
<br />Electronic smoking device means an electronic or battery- operated device
<br />that provides a vapor of nicotine or any other substance and the use or inhalation
<br />of which simulates smoking. The term shall include every variation of such
<br />device, whether manufactured, distributed, marketed, or sold as an e- cigarette, e-
<br />cigar, e- cigarillo, e -pipe or under any other product name or descriptor.
<br />"smoke" shall be defined as follows: the lighting of any cigarette, cigar or
<br />pipe, or the possession of any lighted cigarette, cigar or pipe.
<br />Smoke or smoking means the burning, carrying or possession of any
<br />lighted cigarette, cigar, pipe, or any other matter or substance that contains
<br />tobacco or the using an electronic smoking device.
<br />Tobacco means cigarettes, cigars, cheroots, stogies, and periques;
<br />granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco; snuff
<br />and snuff flour; cavendish; plug and twist tobacco; fine -cut and other chewing
<br />tobacco; shorts, refuse scraps, clippings, cuttings, and sweepings of tobacco; and
<br />other kinds and forms of tobacco, prepared in such manner as to be suitable for
<br />chewing or for smoking in a cigarette, pipe, or otherwise, or both for chewing and
<br />smoking. "Tobacco" also includes cloves and any other plant matter or product
<br />that is packaged for smoking.
<br />Section 6. If any portion of this ordinance is held to be invalid for any reason, such
<br />decisions shall not affect the validity of the remaining portions of this ordinance. The City
<br />Council hereby declares that it would have passed this ordinance and each part hereof
<br />irrespective of the fact that any one part be declared invalid.
<br />Section 7. The repeal or modification of any provision of the Municipal Code of the
<br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole
<br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred
<br />under such provision, and each provision shall be treated and held as still remaining in force for the
<br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the
