C. Any changes which are approved for the final plan must be recorded as amendment to <br />the recorded copy of the final plan at expense of applicant. <br />D. All changes for which authorization is required under subsection A or B of this section <br />shall comply with adopted city development design standards and guidelines. <br />Section 6. Section 17.28.230 of the Louisville Municipal Code is hereby amended to <br />read as follows (words to be deleted are shown in strikeout; words to be added are underlined): <br />Sec. 17.28.230. Control of development after completion. <br />A. After the planned unit development has been substantially completed, the use of the land <br />and the construction, modification or alteration of any buildings or structures within the <br />planned unit development will be governed by the approved final development plan <br />rather than by any other provisions of this title. <br />B. After the planned unit development has been substantially completed, no changes may <br />be made in the approved final development plan except upon application to the city <br />under the procedures provided below: <br />1. Any minor extension, alteration or modification, measuring a 10% or less deviation <br />from the approved plan of existing buildings or structures may be authorized by the <br />director of planning if they are consistent with the purposes and intent of the final plan. <br />The director may also approve minor changes pursuant to the administrative variance <br />procedures and criteria set forth in section 17.52.050. <br />2. Any uses not authorized by the approved final plan, but permitted in the planned unit <br />development as a use by right under the provisions of this title or by a special review in <br />the zone in which the planned development is located, may be added to the final <br />development plan under the procedures stated in chapter 17.40. <br />3. A building or structure that is totally or substantially destroyed may be reconstructed <br />only in compliance with the final development plan unless an amendment to the final <br />development plan is approved under subsection B.4 of this section. <br />4. All other changes in the final development plan, including changes in the use of <br />common open space, must be made by the planning commission and the city council <br />under the procedures authorized by chapter 17.28 for final development plan approval. <br />No changes may be made in the final development plan unless they are required for the <br />continued successful functioning of the planned unit development, or unless they are <br />required by changes in conditions that have occurred since the final plat was approved or <br />by changes in the development policy of the community. <br />Section 6.
