The two properties are located on the south side of an alley which runs east and west
between Main Street and County Road. The alley is located north of Community Park and
provides access for 5 properties.
These properties are zoned RM and located within the Old Town Overlay District. The
regulations for the Old Town Overlay District are found in Section 17.12.050 of the
Louisville Municipal Code (LMC). The rear yard setback requirement for an accessory
structure in Section 17.12.050 is 3 feet from the property line; a zero rear yard setback is
permitted if the property is adjacent to an improved 20' wide alley. Because the alley has
not been improved, the rear yard setback requirement for these properties is 3 feet.
There have been two previous right of way vacations involving this alley:
• Ordinance 489 (1975) — a request to vacate the alley between Lots 14 and 15, and
Lots 16 and 17, Block 8 of Murphy Place.
• Ordinance 1487 (2006) — a request to vacate a portion of South Front Street south
of the alley.
+J
CI)
•
+J
Cry
Gc
R x 5 TWEET
,t -
4-
s. 4 . 7- R IF •
Ord. 489
+0
r
+J
O
w
CI)
Alley
requested to
be Vacated
The Public Works Department has stated they do not wish to retain the un- developed alley
between 225 County Rd. (Lots 12 and 13) and 224 Front Street (Lots 10 and 11), Block 9,
Murphy Place.
If the requested variance is approved there will be no physical change to the existing
garages.
REVIEW CRITERIA:
The BOA has authority to hear and decide, grant or deny this application for a variance
from Section 17.12.040 of the LMC by the powers granted the BOA in Section 17.48.110
of the LMC. The BOA may grant a variance only if it makes findings that all of the criteria,
as established under Section 17.48.110.B.1 -6, have been satisfied, insofar as applicable:
3
