Potholes, cracked parking curbs, and other signs of lower <br />maintenance levels are evident. <br />Defective or unusual conditions of title rendering the title non - marketable: Developed in <br />the 1990s as part of a retail center. Restrictive covenants put in place at time of <br />development to limit competition between tenants and sharply limit entertainment uses. <br />Most notable restriction is that no competing grocer to Albertson's is allowed. More <br />broad restrictions put in place during sale from Sam's Club to current owners after the <br />store closed. <br />Substantial Physical Underutilization or Vacancy of Buildings or Sites: Parking lot sits <br />mostly empty during normal business hours; Ascent Community Church uses property a <br />small portion of the week; high profile location at gateway into Louisville from US 36; <br />one of the main anchor retail properties in shopping area. <br />Blight Resolution: Several meetings were held; LRC - June 30, 2014; Public information <br />meeting —July 7, 2014; City Council — July 15, 2014. On August 18, 2014 the City <br />Council directed staff to bring forward a blight resolution for their review. It was noted <br />the property owner and tenants provided consent letters to the blight determination. <br />Staff Recommendation: Staff recommended City Council approval of Resolution No. <br />60, Series 2014, which defines the four (4) blight factors in the Study Area. <br />COUNCIL COMMENT <br />Council member Stolzmann was not interested in using TIF funds for this project. <br />Mayor Pro Tem Dalton did not support the process. <br />Council member Moss stated she is struggling with the project. She concurred with <br />Council member Stolzmann, TIF funds should not be used for this project. <br />Mayor Muckle noted the Council is not discussing an Urban Renewal Plan. Council <br />may entertain a resolution for pursuing an Urban Renewal Plan at a later time. He <br />noted the property has been vacant for four years and has a major negative impact on <br />the region, even though staff and others have put in a significant effort into filling this <br />space. He was willing to take the next incremental step, but if a plan was created, he <br />did not anticipate TIF financing. <br />Council member Keany was willing to support the resolution. He noted there has been <br />a lot of discussion on this matter, but was willing to take an incremental step at this time. <br />Mayor Muckle called for public comment and hearing none, closed the public hearing. <br />
