Renewal Application - Brinker Restaurant Corporation D/B/A Chili’s <br />Grill & Bar Inc. #465 - Hotel & Restaurant Liquor License – 585 <br /> McCaslin Blvd. <br />Carlsoncalled for any changes to the consent agenda. Liptonmoved the <br />consent agenda be approved. Machadoseconded. Roll Call Vote: Hughes <br />– yes, Lipton – yes, Machado – yes, Tennessen – yesand Carlson – yes. <br />Consent agenda approved. <br /> <br />Authority Business <br />A. Change of Location – Compassionate Pain Management, LLC <br />d/b/a Compassionate Pain Management – Combined Use <br />Marijuana Center – 1116-7 W. Dillon Road <br />Carlson noted the memorandum regarding this change of location and the staff <br />recommendation to not deny the application. He asked if there were members in <br />the audience who wanted to speak concerning the application. Shaun Gindi, <br />owner of Compassionate Pain Management, stated he was available if there <br />were any questions. <br />Authority member Hughes asked if Compassionate Pain Management was a <br />non-conforming use under Louisville’s current land use code. AuthorityAttorney <br />Culley stated she would not classify it as non-conforming. An ordinance passed <br />by City Council gives them the ability to move within 1,320 feet of their current <br />location and from the other marijuana establishment, but does require them to <br />meet the other distance restrictions, which include schools. <br />Hughes asked about the school definitions in Section 5.11.020 difference the <br />Planned Community General Development Plan and the Planned Unit <br />Development (PUD). Authority Attorney Culley explained theplanned community <br />general development planmentioned here was specific to St. Louis Schooland <br />assuring there were no marijuana establishments within 1,320 feet of their <br />location. <br />Machado asked about the availability of areas for marijuana businesses. It was <br />noted the areas would be limited. Machado inquired about the federal limitations <br />concerning distances from schools. Attorney Culleynoted the Authority was <br />tasked with enforcing only the City and State limitations and the applicant was <br />responsible for awareness and risks regarding federal requirements. <br />Hughes asked about the exceptions approved by City Council allowing this <br />business to move. Mr. Gindi, owner of CompassionatePain Management, said <br />he had asked for the ability to move knowing the space he is now in is under- <br />sized. He noted he has already done some work on the new space and never <br />imagined he would run into difficulty because of a school locating nearby. <br /> <br />
