B. It shall be unlawful for any person to consume marijuana on the <br />premises of a medical marijuana center, medical marijuana - infused products <br />manufacturing facility, retail marijuana store or retail marijuana products <br />manufacturing facility, as defined in Sections 5.10.020 and 5.11.020 of this Code, <br />respectively. <br />C. Nothing in this Section shall be construed to prohibit the use or <br />consumption of medical marijuana or marijuana by patients or persons twenty -one <br />(21) years of age or older in a private residence in full compliance with Sections <br />14 and 16 of Article XVIII of the Colorado Constitution and other applicable <br />laws. <br />Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br />Section 3. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br />Section 4. All other ordinances or portions thereof inconsistent or conflicting with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br />Section 5. Any person convicted of violating this ordinance may be punished by a fine <br />of not more than $2,650.00, as shall be adjusted for inflation pursuant to C.R.S. § 13 -10 -113, or <br />by imprisonment not to exceed one year, or by both such fine and imprisonment; except that a <br />child under the age of eighteen years of age shall not be confined in a jail, lockup or other place <br />used for the confinement of adult offenders but may be held in a juvenile detention facility as <br />provided in C.R.S. § 31 -10 -113. <br />Ordinance No. 1675, Series 2014 <br />Page 2 of 3 <br />
