which had been complied with. Resolution NO.68 had one condition: That the sidewalk
improvements be deferred and a letter of credit submitted in the amount of $20/linear foot prior to
issuance of a Certificate of Occupancy.

Davidson called for the applicant's presentation.

Dan Hunter, architect, 1002 Walnut, Boulder, Colorado, was there to answer any questions.

John Quinlan, Quinlan Construction, Inc., 5540 Central Avenue, Suite 100, Boulder, Colorado
80301, pointed out that they have to pay a fee at the bank every year that the letter is in effect and
if the sidewalks are not installed for several years, it would be an additional cost.

Davidson called for Council comments.

Mayer stated that he would be concerned if in eight months they did not come up with a sidewalk
plan for CTC. At that point, there is no need for the letter of credit anymore.

Keany wanted the letter of credit policy to apply to all development at CTC, not just a few.

Lathrop thought it would be unfair at this point to impose an obligation on this applicant, in the older
part of the park, that had not been imposed on previous applicants as recently as six weeks ago.

Levihn was not sure they needed sidewalks at CTC.

Lathrop moved that Council adopt Resolution No. 68, Series 1996, Final PUD Development Plan,
CTC, Lot 7, Block 5, incorporating the language for the development of sidewalks at the time the
master plan is improved, deleting the $20/linear foot language, seconded by Keany. Roll call was
taken. Motion passed with a 5 - 1 vote with Sisk voting against and Howard being absent.

ORDINANCE NO. 1236, SERIES 1996 - PROVIDING FOR THE DECRIMINALIZATION
OF CERTAIN TRAFFIC OFFENSES AND OTHER MISCELLANEOUS CODE
VIOLATIONS - 1ST READING - SET PUBLIC HEARING 11/19/96

Tanoue read by title only Ordinance No. 1236, Series 1996, "An ordinance providing for the
decriminalization of certain traffic offenses and other miscellaneous code violations."

Sisk moved that Council approve Ordinance No. 1236, Series 1996, at first reading, set out for
publication, and set the public hearing for November 19, 1996, seconded by Keany.
