(3) RESOLUTION NO. 73, SERIES 1996 - LEVYING GENERAL PROPERTY TAXES FOR THE YEAR 1996, TO HELP DEFRAY THE COSTS OF GOVERNMENT FOR THE CITY OF LOUISVILLE, COLORADO, FOR THE 1997 BUDGET YEAR Sisk moved that Council adopt Resolution No. 73, Series 1996, setting the mill levy, seconded by Levihn. Roll call was taken. Motion passed by a 6 - 0 vote with Howard being absent. ACQUISITION OF OPEN SPACE - FINAL DETERMINATION Dianne Ray, Finance Director, stated that this is a supplementary appropriation of $600,000 added to the Conservation Trust Land Acquisition Fund to allow Louisville the capabilities to purchase this land in 1996. 1. RESOLUTION NO. 74, SERIES 1996 - AMENDMENT OF THE 1996 BUDGET FOR PURCHASE OF OPEN SPACE - PUBLIC HEARING (PUBL. LSVL. TIMES 11/23/96) Davidson opened the public hearing calling for anyone wishing to speak on Resolution No. 74. None Davidson closed the public hearing and called for Council comments or motions. Lathrop moved that Council approve Resolution No. 74, Series 1996, acquisition of open space, final determination, seconded by Sisk. Roll call was taken. Motion passed by a 6 - 0 vote with Howard being absent. 2. RESOLUTION NO. 75, SERIES 1996 - APPROVING A PURCHASE CONTRACT TO BUY AND SELL REAL ESTATE Bill Simmons, City Administrator, commenting on Resolution No. 75 and Ordinance No. 1243, stated that this is approving the purchase contract to buy the 20 acres located east of Heritage Park and north of Cherry Street. The contract had been agreed upon by the seller. State statute states that any purchase of open space needed to be authorized by ordinance, hence Ordinance No. 1243. He pointed out that there is an emergency clause contained in the ordinance making it effective upon signature by the Mayor. Davidson called for Council questions or motions. Sisk asked about the seller providing the title insurance, not the City of Louisville, as was discussed. 4
