<br />(3) RESOLUTION NO. 73, SERIES 1996 - LEVYING GENERAL PROPERTY <br />TAXES FOR THE YEAR 1996, TO HELP DEFRAY THE COSTS OF <br />GOVERNMENT FOR THE CITY OF LOUISVILLE, COLORADO, FOR <br />THE 1997 BUDGET YEAR <br /> <br />Sisk moved that Council adopt Resolution No. 73, Series 1996, setting the mill levy, seconded by <br />Levihn. Roll call was taken. Motion passed by a 6 - 0 vote with Howard being absent. <br /> <br />ACQUISITION OF OPEN SPACE - FINAL DETERMINATION <br /> <br />Dianne Ray, Finance Director, stated that this is a supplementary appropriation of $600,000 added <br />to the Conservation Trust Land Acquisition Fund to allow Louisville the capabilities to purchase this <br />land in 1996. <br /> <br />1. RESOLUTION NO. 74, SERIES 1996 - AMENDMENT OF THE 1996 <br />BUDGET FOR PURCHASE OF OPEN SPACE - PUBLIC HEARING (PUBL. <br />LSVL. TIMES 11/23/96) <br /> <br />Davidson opened the public hearing calling for anyone wishing to speak on Resolution No. 74. <br /> <br />None <br /> <br />Davidson closed the public hearing and called for Council comments or motions. <br /> <br />Lathrop moved that Council approve Resolution No. 74, Series 1996, acquisition of open space, final <br />determination, seconded by Sisk. Roll call was taken. Motion passed by a 6 - 0 vote with Howard <br />being absent. <br /> <br />2. RESOLUTION NO. 75, SERIES 1996 - APPROVING A PURCHASE <br />CONTRACT TO BUY AND SELL REAL ESTATE <br /> <br />Bill Simmons, City Administrator, commenting on Resolution No. 75 and Ordinance No. 1243, stated <br />that this is approving the purchase contract to buy the 20 acres located east of Heritage Park and <br />north of Cherry Street. The contract had been agreed upon by the seller. State statute states that any <br />purchase of open space needed to be authorized by ordinance, hence Ordinance No. 1243. He <br />pointed out that there is an emergency clause contained in the ordinance making it effective upon <br />signature by the Mayor. <br /> <br />Davidson called for Council questions or motions. <br /> <br />Sisk asked about the seller providing the title insurance, not the City of Louisville, as was discussed. <br /> <br />4 <br />
