Revitalization Commission <br />Minutes <br />October 13, 2014 <br />Page 5 of 7 <br />Chair Becker asked what do you recommend Commissioners say to public who <br />say we are adding value to property and being compensated for it? <br />DeJong: This is making the land in Core Are more useable, and therefore, more <br />valuable. The City is being compensated for loss of value /flexibility of the land <br />encumbered by the detention pond. <br />Commissioner Lathrop said this is more akin to easement. City retains <br />ownership but use is restricted. $1.80 seems appropriate <br />Commissioner Tofte said since property owners are required to use it what if only <br />DELO only uses it? Is there a chance other property owners will not use it? <br />DeJong: there is a chance. For owners to provide detention onsite would be <br />expensive. This would be a better deal but ultimately it will be their decision. <br />The LRC may not be compensated. DeJong has talked with some of the other <br />property owners. <br />Commissioner Tofte asked if we could require usage? DeJong replied yes, but <br />would require deed restrictions. Instead we have taken the voluntary approach. <br />Commissioner Menaker said it would be hard to envision a scenario where it <br />would make financial sense to build individual detention ponds. <br />Attorney Light said the City would have to adopt enactment to force use. <br />Randy Caranci asked questions leading to why is the LRC buying the land <br />instead of the City giving it to the LRC. City Manager Fleming said this is part of <br />cost of doing business. There is a separation of legal entities. Benefit to urban <br />renewal area exceeds cost. <br />Mayor Muckle added there may not be the votes on Council to sell the land at <br />$1.80. The City has been actively using the land that has value to citizens. This <br />use will be lost. Property has significant value to city, maybe not to developer but <br />to use for city for benefit for citizens. <br />Commissioner Tofte remarked that he thought biosolid program was suspended. <br />City Manager Fleming said it has been, but the City still provides access to <br />biosolids. <br />LRC directs staff to move forward. <br />c.
