City Council
Meeting Minutes
November 3, 2014
Code of Ethics, but only where specific circumstances exist. This allows a method for
defense where the alleged conduct may be within the "course and scope" but defense
through the City Attorney's office is not appropriate because of a need to avoid conflicts
or appearance of conflicts.
The policy applies to the City's elected and appointed officials and employees. As a
practical matter, where a claim or legal proceeding is covered by the City's insurance,
the City's obligations for defense and indemnity are carried out through the insurance
claims defense and adjustment processes.
Fiscal Impact: Adopting the proposed defense and indemnification policy will not impact
legal or claims handling costs because it simply codifies the City's obligations to defend
and indemnify City elected and appointed officials and employees against claims and
liabilities arising in the performance of their duties, and the related procedures,
exceptions and conditions.
