City Council <br />Meeting Minutes <br />November 3, 2014 <br />Page 15 of 18 <br />Code of Ethics, but only where specific circumstances exist. This allows a method for <br />defense where the alleged conduct may be within the "course and scope" but defense <br />through the City Attorney's office is not appropriate because of a need to avoid conflicts <br />or appearance of conflicts. <br />The policy applies to the City's elected and appointed officials and employees. As a <br />practical matter, where a claim or legal proceeding is covered by the City's insurance, <br />the City's obligations for defense and indemnity are carried out through the insurance <br />claims defense and adjustment processes. <br />Fiscal Impact: Adopting the proposed defense and indemnification policy will not impact <br />legal or claims handling costs because it simply codifies the City's obligations to defend <br />and indemnify City elected and appointed officials and employees against claims and <br />liabilities arising in the performance of their duties, and the related procedures, <br />exceptions and conditions. Staff recommended the City Council adopt Ordinance No. <br />1676, Series 2014 on second and final reading. <br />COUNCIL COMMENT <br />Council member Loo explained the Legal Committee reviewed this matter very <br />thoughtfully and recommended City Council approval. <br />Mayor Muckle requested public comments and hearing none, closed the public hearing. <br />MOTION: Council member Loo moved to approve Ordinance No. 1676, Series 2014 on <br />second and final reading, seconded by Council member Lipton. Roll call vote was <br />taken. The motion carried by a vote of 7 -0. <br />ORDINANCE No. 1677, SERIES 2014 — AN ORDINANCE AMENDING CHAPTER <br />5.11 OF THE LOUISVILLE MUNICIPAL CODE TO PROHIBIT MARIJUANA CLUBS — <br />1st Reading — Set Public Hearing 11/18/2014 <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No.1677, Series 2014. <br />MOTION: Mayor Muckle moved to approve Ordinance No. 1677, Series 2014 on first <br />reading, ordered it published and set a public hearing for November 18, 2014, seconded <br />by Mayor Pro Tem Dalton. All were in favor. <br />APPROVE RESOLUTION No. 66, SERIES 2014 — A RESOLUTION <br />RECOMMENDING APPROVAL OF A NEW, NON - CONFORMING MONUMENT SIGN <br />IN DOWNTOWN LOUISVILLE LOCATED AT 1150 PINE STREET <br />Mayor Muckle requested a staff presentation. <br />
