Board of Adjustment <br />Meeting Minutes <br />December 17, 2014 <br />Page 2 of 7 <br />1) Open Public Hearing <br />2) Opening Statement by Chair <br />3) Public Notice and Application Certification <br />4) Disclosures <br />5) Staff Presentation and Questions of staff <br />6) Applicant Presentation and Questions of applicant <br />7) Public Comment <br />8) Applicant discussion of public comment, if any <br />9) Closing statement by staff and applicant and Final questions by board <br />10) Close public hearing and Board discussion and action <br />Fuller reviewed the procedures for the meeting; opened the public hearing; and stated <br />there are six criteria which must be met for the board to approve a variance request. <br />Ewy then stated copies of the criteria are located on the table next to entryway. He <br />asked for verification of proper public notice. <br />Robinson verified all applications to be heard this evening are complete, and were <br />mailed to surrounding property owners on November 26, 2014, published in the Boulder <br />Daily Camera on November 30, 2014; and the properties were posted on posted on <br />November 26, 2014. <br />Borrmann moved and Malmquist seconded a motion that all requirements have been <br />satisfied and the applications submitted by the applicants have been properly filed. <br />Motion passed by unanimous voice vote. <br />Fuller asked if anyone at the hearing had any objections to the hearing procedures he <br />had described and asked if there were any other preliminary matters that needed to be <br />taken care of. None were heard. <br />Fuller asked for disclosures from the board members for any site visits, ex parte <br />communications, and any conflicts of interest or required disclosures on both <br />applications <br />All Board members indicated they did not hav ny ex parte communications or any <br />conflicts of interest for both applications. <br />Fuller stated that for the111111â– requested variancbe approved, four (4) of the five (5) votes <br />would need to be affirmative. <br />Fuller asked the applicants if they were ready to proceed with the hearing. <br />The applicants indicated they were ready to proceed with the hearing. <br />Staff Presentation of Facts and Issues: <br />Robinson summarized the request for a side yard setback variance for 501 Jefferson: <br />Background: <br />a. Property is zoned Residential Low (RL) <br />b. Street side setback requirement is 15 feet and rear setback is 0 <br />feet. <br />c. Garage is 2 feet 6 inches from the southern (street side) property <br />line. Garage was built in 1974. <br />d. Request is to add a second story. <br />e. A variance is required to alter or expand the existing garage. <br />Staff believes all applicable criteria have been met. <br />
