This will be brought back to <br />Council's next meeting for discussion. <br />ORDINANCE #1018, SERIES 1989 - QUIT CLAIM DEED - ROOSEVELT STREET, PUBLIC <br />HEARING Read by title only, Ordinance #1018, Series <br />1989, "An Ordinance Authorizing and directing <br />the Mayor and City Clerk to Execute and Deliver <br />a Quit Claim Deed to certain real property <br />adjacent to Roosevelt Street." Publication and <br />notice of public hearing were certified by the <br />City Clerk. <br />Mayor Fauson opened the public hearing. <br />Franklin explained that the property owners, <br />Nicholino Sozio, Luciano Colabello, Pasquale <br />Colabella and Antonia Melchior, have asked the <br />City to assist in clearing up an ownership <br />question which affects the status of their <br />land title. The title company is not able to <br />establish City or private ownership of a 7' x <br />49.7' strip of land located at the west end of <br />the property located within what would <br />ordinarily be the Roosevelt Street right-of- <br />way. However, the subdivision plat which would <br />have dedicated this right-of-way segment, <br />Parbois Addition, was never recorded and the <br />right-of-way was never deeded. Although the <br />public has historically enjoyed use of the <br />street and the sidewalk next to this property, <br />the strip of land has been fenced off and <br />occupied by part of a dwelling and other <br />private improvements. To clear the ownership <br />for this strip of land, the City may by <br />ordinance quit claim its interest. No public <br />utilities or easements are affected by such <br />action. <br />Mayor Fauson asked if there were any public <br />comments. None. <br />Mayor Fauson closed the public hearing and <br />called for a motion. <br />Carnival moved and Howard seconded to adopt <br />Ordinance #1018, Series 1990, on second and <br />final reading.
