Special Review Use for the Tri-City Elks <br />Lodge . ~~ <br />Franklin stated that according to the zoning <br />regulations a Special Review Use may be granted <br />for uses other than the predominant use if, <br />generally speaking, the use and the <br />neighborhood are compatible. Amendments to <br />approved Special Review Uses are processed in <br />the same manner as the original application. <br />The applicant, Tri-City Elks Lodge #2541, <br />requests an amendment to the Special Review Use <br />for the Lodge which is located at 525 Main <br />Street. The amendment will allow the patio <br />area against Main Street to be enclosed. <br />Planning Commission held a public hearing on <br />December 12, 1989 and recommends approval with <br />three conditions: 1) areas utilized for parking <br />on the recently leased parcel shall have a <br />durable and dustless surface maintained for all <br />weather use, 2) the applicant shall install a <br />5'-6' sight-obscuring fence on the recently <br />leased parcel adjacent to any residential use, <br />and 3) the plan be updated to reflect as-built <br />conditions. The first two conditions apply <br />when the parking lot is constructed. The third <br />condition has been met. <br />Council asked if there were any objections at <br />the public hearing during Planning Commission <br />review. Franklin stated that there were not. <br />Mayor Fauson moved and Carnival seconded to <br />adopt Resolution #6, 1990. By Roll Call Vote <br />the motion passed 6-0. <br />UPDATE - LEGISLATIVE <br />ISSUES Franklin presented three bills scheduled for <br />1990 introduction to the Colorado State <br />legislators regarding annexation, urban renewal <br />and impact fees. The Colorado Municipal League <br />will sponsor a major annexation bill being <br />introduced by Senator Joe Winkler, an expert on <br />annexation legislation. The League is in <br />strong support of this bill and is urging city <br />officials to co-sponsor the bill. Although it <br />is a comprehensive statewide solution <br />addressing many of the annexation <br />controversies, it is not a bill intended to <br />resolve any one localized land use dispute <br />between a county and municipality. <br />The urban renewal bill was introduced by the <br />legislature's Interim Committee on Independent <br />Governmental Authorities and would restrict <br />significantly the statutory powers of urban <br />7 <br />
