HEALTH PARK SUBDIVISION Williams stated he had received a letter from Mr. Beezley on behalf of the Health Park Subdivision with respect to the motion to table the replat for the Health Park. Mr. Beezley is present. If council wants to bring this up for discussion one of the members that voted to table this issue must make the motion to bring it back up. Howard asked if anything has been done with regard to the water line? Franklin stated Mr. Beezley did submit a cost estimate that involved cost for the connection to the maintenance building. I did refer that over to Public Works department for review and that review is still in the works. We have not finished review so we have not followed up with a final meeting. Davidson stated he felt we are getting really close to resolving this issue and putting these kind of things behind us. I think it would be better to wait as we originally planned and go ahead and get all of this issues resolved. Alan Beezley on behalf of the Avista Hospital. Beezley stated in the construction finance package between the medical office corporation and United Bank of Denver there is an April 24 dead line for obtaining the replat approval. The request was considered and approved by the Planning Commission in March and first appeared before Council on April 3. It was then table to consider the unrelated water line issue, then again on April 17. Under the terms of the construction loan agreement it is a violation of the construction loan to not obtain the replat, this could termi- nate the construction loan or ca11_ the entire construction loan due. I have been told by the staff and the city attorney that the replat request meets all of the city's requirements. There is no bases for the city not to act on this. The water line is a different issue and we are trying to resolve this in good faith. 9
