Since Mr. Franklin is the one that <br />Flagstaff has been working with maybe he would be <br />the one to negotiate with us on behalf of the city <br />and reach certain agreements. Flagstaff is very <br />willing to reach some sort of accommodation to the <br />homeowners and the City Council to ensure that the <br />improvements are completed. I do not see a breach <br />of the subdivision agreement at this time. <br />Carroll Meehan, 501 W. Eisenhower Drive, Louisville, Co. <br />Meehan: I am here to represent the homeowners association <br />for the Ponderosa Subdivision. Much of what I <br />have had to say has been addressed by Mr. <br />Franklin. Approximately 1/3 of the lots have <br />homes on them. Since 1985 Flagstaff Enterprises <br />has yet to complete the following improvements: <br />street lights, final asphalt lift on the street, <br />landscaping, bike path. We have a half completed <br />entrance to the subdivision. It is our interest <br />and desire to have these improvements completed as <br />quickly as possible by qualified contractors. As <br />Mr. Franklin pointed out there are several <br />alternatives to have this done. The two <br />alternatives that should be explored are 1) the <br />City use the held funds to complete the <br />improvements in a timely fashion, and 2) we <br />propose that the Letter of Credit be in a form of <br />written agreement between the City of Louisville <br />and Flagstaff Enterprises, that we have access to <br />that agreement and that the agreement contains the <br />stipulations that the association has outlined to <br />the City Council. Is there a Flagstaff <br />Enterprise? If there is no Flagstaff Enterprise <br />who would the City enter into an agreement with? <br />If the Letter of Credit is agreed to and Caranci <br />doesn't use the $30,000 to make the improvements <br />how quickly can the city draw on the funds that <br />are available from the Letter of Credit and will <br />there be delays in getting those funds. We are a <br />very concerned neighborhood, we are concerned <br />about one of the biggest investments that we will <br />
