Griffiths: In terms of amount, the agreement talks about <br />125$ of the cost of the improvements. We would be <br />looking at a Letter of Credit or improvements of <br />125 of $108,000. Also it was not clear whether <br />your idea is that they complete those improvements <br />within the 90 day period or only that we reach an <br />agreement during that 90 day period for completion <br />of the improvements and a time table. <br />Sackett: I think they should have 30 days to reach an <br />agreement, if they don't reach an agreement in 30 <br />days then we seek litigation. The agreement will <br />have a specific time frame for completing the <br />improvements that would be acceptable and reasona- <br />ble by the homeowners and the city. Included in <br />that agreement is the establishment of a Letter of <br />Credit. That would be my recommendation. <br />Carnival: Which is the quickest way to resolve this problem? <br />Is it a Letter of Credit or is it alternate one. <br />I need some clear understanding of alternate one. <br />In alternate one it says that the city will com- <br />plete the improvements with the funds held. <br />Through negotiations with Mr. Caranci can you not <br />negotiate who does those improvements. Can it not <br />be someone else? <br />Brand: Yes we can negotiate that. <br />Carnival: From the work session it was may understanding <br />that there is another contractor in place that is <br />willing to do the work and that the city, with the <br />funds available, proceed with the completion of <br />the projects and deal with a reputable contractor, <br />if we seem to think that Mr. Caranci is not. <br />Brand: I think that Councilmember Sackett has the right <br />solution. That we take the 30 days to negotiate <br />the contract with Mr. Caranci. If we can negoti- <br />ate that contract in 30 days and in that contract <br />we have a list of the improvements that have to be <br />made and the schedules by which they will be made <br />and what will happen if they aren't. I believe we <br />are working toward the solution and we would have <br />reasonable schedules because we will be working <br />with the Public Works Director who can tell us how <br />long it will take. Also in that agreement if we <br />are to do any of the improvements as a city, we <br />come under the requirements for bidding projects <br />that will slow it down. If we have 30 days in <br />which to negotiate the contract we could work out <br />all the other details. If the negotiations break <br />down then we come back to you at the end of 30 <br />days and then we would get other directions. <br />
