information: 1) The proposed budget is open for <br />inspection, 2) the place where the proposed budget <br />may be examined, 3) date the proposed budget will <br />be considered for adoption, and 4) any interested <br />taxpayer may express their objections any time <br />prior to final adoption of the budget. <br />Mayor Fauson moved and Carnival seconded to publish the notice as <br />to the proposed budget and set public hearing for budget adoption <br />on December 4, 1990. Motion Passed 7-0. <br />DISCUSSION/ACTION - APPOINTMENT OF CITY ATTORNEY <br />Brand: The firm of Griffiths & Tanoue was retained as <br />Interim City Attorney in August. Council agreed <br />to a three-month interim period. Griffiths & <br />Tanoue have provided exceptionally fine service <br />from the standpoint of both responsiveness and <br />legal expertise. They have on several occasions <br />responded to emergency time requirements imposed <br />by courts or other circumstances and have given <br />Louisville their full attention to meet these <br />extreme deadlines. I recommend that we continue <br />the services of Griffiths & Tanoue as our City <br />Attorney. Also Susan Griffiths has stated that <br />she would leave the room while Council discusses <br />this item if Council so desires. <br />Mayor Fauson moved and Carnival seconded to retain Griffiths and <br />Tanoue as City Attorney's. Motion passed 7-0. <br />DISCUSSION/DIRECTION - OPEN GOVERNMENT RESOLUTION - CONTINUED <br />FROM NOVEMBER 6, 1990 COUNCIL MEETING <br />Davidson: At the last regular Council meeting at which I was <br />absent for business reasons, Councilmember <br />Carnival expressed his belief that by my speaking <br />at a public meeting of the MTDC, on the issue of <br />the W-470 beltway, I had some how violated <br />Council-member Hornbostel's Open Government <br />Resolution. My belief is that as a Council- <br />member, I still have my First Amendment right to <br />freedom of speech. I believe that my opinion as a <br />Councilmember, while it may get more attention by <br />the MTDC than that of a non-elected citizen, is <br />just that, my opinion. Clearly anytime an elected <br />official gives his opinion on an issue, some may <br />mistakenly take that opinion as an official <br />stance. I was very careful in choosing my words <br />at the public meeting, so that they would not be <br />mistakenly interpreted as a city position. Beyond <br />that, there is little I can do.
