Brand: What if we take the eight services and have them <br />rate them on very-important, important, less- <br />important, not-important would that work? <br />Sackett: Yes, maybe that would work. <br />Mayor Fauson: Asked if there is any objection to the draft? <br />Brand: It still has to go to Scripps Howard and if there <br />are any changes I will bring it back to you. <br />VIOLATION OF ETHICS CODE <br />Howard: I feel there has been a breach of the Municipal <br />Code section 2.80.010 through 2.80.060. When <br />this first came to my attention I consulted the <br />Municipal Code Book so that I might respond <br />correctly. According to the Municipal Code Book <br />section 2.08.060 if I have any question regarding <br />any possible violation I may "apply to the <br />Prosecuting Attorney for advise to this matter." <br />On Friday February 16th I met with the City <br />Prosecuting Attorney and was advised that my <br />concerns were well founded on the matter brought <br />before him. The Section "Public Office may not be <br />used for personal gain." Councilman Randy <br />Carnival, as a employee of the city is a swim team <br />coach and is the only paid position in the city <br />and has violated the Ethics Code everytime he has <br />spoken for the recreation center and has voted for <br />any city budget which has given raises to the swim <br />team coach, even a cost of living raise. In <br />addition every trade off made by Councilman <br />Carnival for parks and recreation is a potential <br />conflict. Unlike Councilman John Sackett who has <br />repeatly received conflicts and stated so, <br />Councilman Carnival has not. In the Ethics Code <br />it states that the Mayor "shall direct the city's <br />prosceuting attorney to investigate the matter <br />within 10 days." All of the votes that Councilman <br />Randy Carnival has taken must be examined. <br />Mayor Fauson called for a five minute recess so that the City <br />Attorney could look at the code. <br />Mayor Fauson called the meeting back to order. <br />Griffiths: Stated that because Councilman Howard's code book <br />was not up-to-date, the code states that a written <br />letter must be presented to the Mayor and then he <br />must decide within 10 days whether to have this <br />refered to the Prosecuting Attorney or whether to <br />have an outside attorney look at the violation.
