James (Mike) Langston, Operations Maintenance Technician I <br /> <br />Steve Baysinger, Parks & Recreation Director, introduced: <br /> <br />Stephanie Gregg, Recreation Supervisor I <br /> <br />Bill Blankenship, Human Resources Officer, introduced: <br /> <br />Katrina Gabel, Accounting Clerk I (unable to attend) <br /> <br />RESOLUTION NO. 37, SERIES 1995 - MEADOWS AT COAL CREEK - AMENDMENT <br />TO THE FINAL PUD DEVELOPMENT PLAN (CONTINUED FROM 7/6/95) <br /> <br />Sisk asked to be excused due to a conflict of interest. <br /> <br />Davidson excused Sisk. <br /> <br />Paul Wood, Planning Director, stated that a~er further analysis, he recommended no relief for lots <br />with less than 115' of lot depth and side-loaded garages. Based upon the lot size limitation and the <br />unlikely event that any ranch construction would occur on the smaller lots, he recommended that they <br />eliminate that portion of the recommendation on the resolution. In lieu of that, he proposed that the <br />first portion of the recommendation on this resolution be maintained, that the front yard setback shall <br />be an average of 20' and a minimum of 19'. Modification would be, except that for a single story <br />home with a front loaded garage, the front yard setback shall be 16.5', which was consistent with the <br />final improvement survey for 555 Orchard; eliminate No. 2; maintain No. 3. The two property <br />owners that have temporary C.O.'s would be eligible for full C.O.'s with this recommendation. It <br />brings all lots into compliance that are currently out of compliance and under a temporary C.O. <br /> <br />Mayer asked that Council consider that the minimum lot size be reduced by 200 s.f. He asked the <br />City Attorney concerning the covenants, if anyone other than 75% of the voting members of Coal <br />Creek would have to give approval, if these documents are filed with the deed. <br /> <br />Susan Griffiths, City Attomey, stated that it could be said that if those covenants were in place at the <br />time the individual purchased the property, it was a matter of public record and everyone had an <br />opportunity to read and understand them, it would be applicable. She commented that it is hard to <br />generalize. <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Ramon Griffin, 555 Orchard Drive, Louisville, Colorado, stated that reducing the minimum size of <br />the homes would probably be strongly opposed by the current owners. <br /> <br /> <br />
