Planning Commission <br />Meeting Minutes <br />February 12, 2015 <br />Page 9 of 12 <br />• The Louisville Municipal Code (LMC) requires a City facility must be approved by a SRU. <br />It is a performance standard requirement. According to the Louisville Municipal Code, <br />Section 17.24.30, the placement and use of a private utility, or the expansion of a <br />municipal land use, in the A zone district requires a special review use (SRU). The plat is <br />needed because the property has never been platted. <br />• The applicant, City of Louisville Public Works Department, has applied for a final plat <br />and special review use (SRU) to authorize an outdoor drying bed (an expanded <br />municipal use) on the Howard Berry Water Treatment Plant property. The drying beds <br />are needed for the water treatment process. The property is currently zoned Agricultural <br />(A). <br />• A Louisville Public Works employee and a consultant are present to give a further <br />definition of a drying bed. Drying beds, also known as "residuals handling facility ", are <br />one of the final steps in the water treatment process. According to the applicant's <br />consultant, "residuals are a byproduct of the treatment process and essentially consist of <br />coagulating chemicals and organic suspended solids removed from the raw water <br />stream. Currently, the residuals are discharged to the City's sewer system and <br />processed at the wastewater treatment plant (WWTP). Elevated metal concentrations <br />have been measured in the WWTP effluent and there is concern that the residuals <br />loading from the water treatment process are the primary source. Handliesiduals on <br />site should reduce the solids and metals load to the WWTP." <br />• The setbacks and height proposed for the drying beds comply with the yard and bulk <br />standards in the LMC. <br />Setback (accessory) Required <br />Front (north) 40 feet <br />Side (east) 20 feet <br />Rear (south) 10 feet <br />Proposed <br />50 feet <br />110 feet <br />50 feet <br />• Overall site plan shows the beds will be located on the northeast side of the existing <br />concrete water tank. There will be little to no impact from the visual because these are <br />ground based and built to go with the topography of the ground. <br />• Public notices were sent out to properties within 500 feet of this property. As of the PC <br />meeting today, no comments had been received. <br />• Staff is working to place a bike route which would connect the existing path coming <br />through Davidson Mesa to an underpass under US 36 and continue on the north side of <br />the treatment plant to connect with the Marshall Open Space. The location of the path <br />will be determined and be part of the condition that discussion continues for the bike <br />path <br />• The Louisville Municipal Code § 17.40.100.A lists five criteria to be considered by the <br />Planning Commission in reviewing a Special Review Use application. All five criteria <br />have been met. <br />Staff finds the proposed drying beds development with condition is consistent with the <br />Louisville Municipal Code Chapter 16, Section 17.40, and Section 17.12.040. Staff <br />recommends Planning Commission approve Resolution No. 7, Series 2015, a resolution <br />recommending approval of a Final Plat and Special Review Use at 7000 Marshall Road <br />with the following condition: <br />1. "the Howard Berry Water Treatment Facility shall dedicate a combination of land and or cash - <br />in -lieu equivalent to, up to, 12% of the project site area needed for the portions of the planned <br />trail and improvements as determined in the Alternatives Analysis" <br />Commission Questions of Staff:: <br />O'Connell asks about barbed wire currently in place. <br />
