Griffiths read by title only Ordinance No. 1200, Series 1995, "An ordinance amending Section <br />17.12.030 of the Louisville Municipal Code to allow public and private schools, studios for <br />professional work, teaching of fine arts, photography, music, drama, and dance in the commercial and <br />industrial zoning districts by special review." <br /> <br />Peter Kernkamp, Planner, stated that this ordinance expands and allows on a case-by-case basis, <br />under the Special Review Use criteria, the Planning Commission and City Council look at these uses <br />in the commercial and industrial zones as well. <br /> <br />Davidson called for Council questions or motions. <br /> <br />Howard moved that Council approve Ordinance No. 1200, Series 1995, an amendment to Chapter <br />17.12 of the district regulations on first reading, set out for publication and set the public hearing for <br />September 19, 1995. Seconded by Keany. All in favor with Sisk being absent. <br /> <br />DISCUSSION/MOTION - JERRY DAVIS - 555 MAIN STREET - REVOCABLE LICENSE <br />AGREEMENT FOR A PRIVATE FENCE IN A PUBLIC RIGHT-OF-WAY <br /> <br />Jerry Davis, property owner, requested authorization of a license agreement to construct a 42" chain- <br />link fence at the back of the sidewalk on all three street frontages at 555 Main Street. He stated that <br />he had made a mistake in his letter to Council on the City's 2.5' of right-of-way on Main Street and <br />2.5' on Elm Street. He stated that it should be 1.5'. <br /> <br />Peter Kernkamp, Planner, pointed out that in Council's packet there was the Revocable License <br />Agreement. <br /> <br />Davidson called for Council's questions or comments. <br /> <br />Davidson commented that in Old Town what Mr. Davis requested was fairly common. <br /> <br />Lathrop felt there would be a problem in putting a chain-link fence right against the sidewalk, on a <br />curve in that location. He felt it invited a problem with bicyclist's handlebars. He stated that two <br />people could not walk side-by-side and would be pushed to the street. He felt the fence should be <br />1' from the sidewalk. <br /> <br />Davis was not in favor of the 1'. <br /> <br />Levihn stated that two doors down there is a garage next to the sidewalk. He felt the gate should <br />open inward instead of out. <br /> <br />Howard asked if there would be any visual obstruction problems or safety concerns. <br /> <br />Kernkamp stated that there would be no visual obstruction problems since it would be chain-link. <br /> <br /> <br />
