A. The permittee shall comply with all terms and conditions of the <br />special event permit. <br />B. The permittee shall ensure that the person leading or in charge of <br />the event is familiar with every provision of the special event permit and carries <br />the special event permit on his or her person for the duration of the special event. <br />C. Immediately following the completion of the special event, the <br />permittee shall ensure that the area used for the special event is cleaned and <br />restored to the same condition as existed prior to the event. If the property used <br />for the event has not been properly cleaned or restored, the permittee shall be <br />required to reimburse the City for any costs incurred by the City to restore the <br />area. <br />Sec. 14.16.100 Revocation. <br />A. The Deputy City Manager may, at any time prior to a special <br />event, revoke or terminate a permit that has been issued for the event if conditions <br />change so that the permit application could have been denied in the first instance. <br />B. The Deputy City Manager, Director of Parks and Recreation, Chief <br />of Police, Director of Public Works or their designee may revoke the permit and <br />terminate the special event during the course of the event if continuation of the <br />event presents an immediate danger to the health, safety or welfare of the <br />participants or public. <br />C. The Deputy City Manager, Director of Parks and Recreation, Chief <br />of Police, Director of Public Works or their designee may revoke the permit and <br />terminate the special event during the course of the event for noncompliance with <br />any term or condition of the permit. <br />Sec. 14.16.110 Appeal. <br />A. Any decision of the Deputy City Manager under this Chapter may <br />be appealed to the City Manager by filing a written notice of appeal, setting forth <br />the grounds for appeal, within five (5) days after the decision. <br />B. The City Manager shall hold a hearing following the filing of such <br />appeal at the office of the City Manager. The hearing must be held within two <br />weeks of the date of the filing of such appeal, at which time the applicant may <br />present any and all evidence, testimony and information relevant to the <br />application. The City Manager, shall, within 24 hours of the appeal hearing, issue <br />his decision either affirming the denial of the application or directing the Deputy <br />City Manager to issue a permit as applied for, subject to the reasonable terms and <br />conditions as outlined in this chapter. <br />Ordinance 1689, Series 2015 <br />Page 7 of 9 <br />
