ORDINANCE No. 1687, SERIES 2015 — AN ORDINANCE AMENDING <br />ORDINANCE Nos. 1165 AND 1166, SERIES 1994 CONCERNING THE <br />GATEWAY ANNEXATION AND APPROVING AN AMENDMENT TO AN <br />ADDENDUM TO ANNEXATION AGREEMENT — 2nd READING — PUBLIC <br />HEARING <br />2. RESOLUTION No. 22, SERIES 2015 — A RESOLUTION APPROVING AN <br />AMENDMENT TO THE GATEWAY FINAL PLANNED UNIT DEVELOPMENT <br />(PUD) TO MODIFY THE HEIGHT ALLOWANCE LANGUAGE ON LOTS 1 AND <br />2, BLOCK 1 FROM "1 STORY WITH A 26 FEET MAXIMUM BUILDING <br />HEIGHT" TO "1 OR 2 STORIES WITH A MAXIMUM BUILDING HEIGHT OF 26 <br />FEET" <br />Mayor Muckle reminded the public they may speak on either agenda item. He <br />requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No. 1687, Series 2016 and Resolution No. 22, <br />Series 2015. <br />Mayor Muckle reopened the public hearing and requested a staff presentation. <br />Planning and Building Safety Director Russ explained this is a Gateway PUD <br />Amendment request. The applicant is requesting an ordinance to modify the height <br />allowance language on Lots 1 and 2, Block 1 from "1 story with a 26 feet maximum <br />building height" to "1 or 2 stories with a maximum building height of 26 feet ". <br />At the April 21st hearing Council directed staff to work with the applicant to determine if <br />there was a potential agreement between the land owner and City to introduce a lot <br />coverage reduction in exchange for the City agreeing to modify the 1 story restriction <br />and permit a 2nd story within the allowed 26 -foot height allowance. The applicant did not <br />want to accept a lot coverage reduction from the allowed 10 %. The applicant requested <br />the City allow a 2nd floor within the allowed 26 -foot height restriction. <br />Staff believes the request, if approved, will not negatively impact the view corridors <br />when compared to what is expected with the current building allowances. <br />Staff Recommendation: Staff recommended the City Council approve Ordinance No. <br />1687, Series 2015 and Resolution No. 22, Series 2015. <br />APPLICANT PRESENTATION <br />Jeremy Weiss, 2287 S.
