Williamson states that this is a reasonable
agreement and recommends approval.
Mohr asked what the cost might be should an
appeal be filed by the opposition should
Council go forward with the July 11th
Election. Williamson stated that he felt it
would likely be $25,000 to $30,000 to resolve
the matter. Stahl stated that approximately
$1,200 has been spent on the current
election, and to begin again, a typical
special election in the City of Louisville
costs approximately $3,000.
Mayor Fauson stated that he feels Council was
correct in their action to bring the issue to a
Special Election. However, due to the cost and
time delay, the Mayor recommended to Council that
they agree to the stipulation and the
agreement and delay the Special Election
regarding the Hillandale annexation ordinance
and hold the Election on August 1, 1989,
modifying the date for the election, does in
no way change Council's position that
Council's previous action in setting a
Special Election was appropriate and legal.
Stahl explained that the ballot question remains
the same except for the change in the date which
appears on the ballot. Mohr seconded the motion and by roll
call vote, the motion passed 7-0.
RESOLUTION #16, SERIES 1989 - SETTING SPECIAL
ELECTION Williamson read by title only Resolution #16,
Series 1989, "A Resolution submitting to the
registered electors of the City of Louisville,
Colorado, at a Special Municipal Election to be
held on August 1, 1989, the question of approving
Ordinance #987 concerning the annexation by the
City of property known as Hillandale; and setting
forth certain details of the election."
Williamson explained that this resolution changes
the date of the election to August 1, 1989.
Sackett stated that his main objective in agreeing
to the date change regardless of the date and the
4
