Ms. Rozaklis thanked Council for their
support that made this report possible.
ORDINANCE #996, SERIES 1989 - PROVISION FOR TEMPORARY LIQUOR LICENSES
AND FEES - 2ND READING,
PUBLIC HEARING Ordinance #996, Series 1989, "An Ordinance amending
Title 5 of the Louisville Municipal Code concerning
the issuance of temporary Liquor Licenses, and
creating the fees therefore." Publication of the
ordinance and notice of public hearing were
established.
Mayor Fauson opened the public hearing.
Ferris explained that Ordinance #996 concerns the
issuance of a temporary liquor license and the fees
to be charged for that license. Senate Bill 113,
effective April 27, 1989, provides for local liquor
licensing authorities to grant a temporary license
to persons who, through negligence or inadvertence,
have allowed their liquor licenses to expire without
renewing them. This Bill does not change the
current law: persons who let their license expire
(without renewing them) must still apply for a brand
new license. However, SB 113 does permit issuance
of a temporary license under certain circumstances:
1) he submits an application for a brand new license
(including appropriate fees); 2) he submits that new
license application within 90 days of the date of
his old license expired; 3) he pays the local
licensing authority $250 for the temporary license.
If the applicant meets these criteria then the local
authority must issue the applicant a temporary
license which is good until the applicant's new
permanent license is issued or denied, or it has
been more than 4 months since the temporary license
2
