TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING <br />CITY MANAGER <br />DATE: FEBRUARY 27, 2008 <br />SUBJECT: SPECIAL MEETING FOR ETHICS TRAINING FOR CITY COUNCIL AND <br />SENIOR CITY STAFF MEMBERS <br />ORIGINATING DEPARTMENT: CITY MANAGER'S OFFICE <br />SUMMARY: <br />Section 4-16 (a) of the City Charter specifies, among other things, that each Council member <br />shall participate in at least one City-sponsored open government-related seminar, workshop or <br />other program at least once every two years and that the program shall provide information on <br />at least these topics relating to municipal government: the theories and policies underlying and <br />laws relating to ethics, open government, open meetings, open records, and promoting citizen <br />participation in municipal government. <br />Twice each year the City Attorney provides open government training sessions for Council <br />members, members of the City's boards and commissions and City staff. However, it has been <br />two years since the City last sponsored an open government and ethics seminar specifically for <br />the City Council and senior staff. Special Counsel Scotty I<;rob has been retained to conduct the <br />seminar. Mr. Krob has been retained by the City specifically for this engagement and has not <br />conducted any other legal work for Louisville. <br />The training session will focus on the City of Louisville's Code of Ethics, and a copy of Article 5, <br />"Open Government and Ethics" of the Louisville Home Rule Charter is attached for your review <br />and reference. There are also provisions of the Colorado :hate Statutes that address ethics <br />and these will be reviewed, however Louisville's code is more restrictive. An overview of the <br />law and the general principles underlying Louisville's Ethics Code will be presented and <br />hypothetical situations will be discussed for an interactive :session.
