<br />Board of Adjustment <br />Meeting Minutes <br />April 10, 2007 <br />Page 5 of 6 <br /> <br />Gratz stated his deck is approximately 9 feet from the path while the neighbor's home is <br />approximately twenty-five (25) feet. <br /> <br />Public Present in Favor of Application: None heard. <br /> <br />Public Present in Opposition of Application: None heard. <br /> <br />Applicant ClosinG Comments: No additional comments. <br /> <br />Staff ClosinG Comments: No additional comments. <br /> <br />Public HearinG Closed / Board Discussion: <br />Cordell stated he opposes any additional analysis request of the applicant. He also <br />stated his support for approval of the variance. He added that when he walked down the <br />path to the open space he felt that he was intruding into the conversation of those on <br />the deck. <br /> <br />Loeblich asked how difficult it would be to obtain the setbacks. <br /> <br />McCartney stated it would take a considerable amount of time and there is no <br />guarantee that an Improvement Location Certificate (ILC) is on file for each lot. <br /> <br />Kelly stated that all six (6) criteria had been met. <br /> <br />Chancellor stated that all six (6) criteria had been met and the path closeness to the <br />home is a more important consideration than the structure location on the lot. <br /> <br />Loeblich asked if the applicant agreed with the condition. <br /> <br />Gratz stated he did. <br /> <br />Motion and Vote: <br />Cordell moved and Kelly seconded a motion to approve the variance request. <br /> <br />Roll Call Vote: <br /> <br />Bill Cordell Yes <br />Gerry Kelly Yes <br />Horst Loeblich Yes <br />James Stuart Excused <br />John Weise Excused <br />Gunnar Malmquist Excused <br />Wayne Chancellor, Associate Yes <br />Motion passed: 4 to 0 <br /> <br />Items tentatively scheduled for May 16, 2007 <br />McCartney reminded the members that the deadline date for applications to be heard at <br />the May 21,2007 meeting is April 20,2007.
