<br />Board of Adjustment <br />Meeting Minutes <br />September 19, 2007 <br />Page 2 of 4 <br /> <br />Public Notice Verification: <br />Schwertfeger verified the public notice was published in the Daily Camera on <br />September 9, 2007; posted in City Hall, the Public Library, the Recreation Center and <br />the Courts and Police Building on September 7, 2007; mailed to surrounding property <br />owners within 500 feet of the subject property on September 7, 2007; the property was <br />posted with the required signage and the appropriate fees were paid. Weise moved and <br />Malmquist seconded a motion to accept the Public Notice Verification information as <br />presented by staff. Motion passed by voice vote. <br /> <br />Board Member Verification of site visits. ex parte contacts and conflicts of interest: <br />Stuart requested Board Member Verification of site visits, ex parte contacts and conflicts <br />of interest. <br /> <br />All members present stated they had done a site visit, had no contacts with the <br />applicant and no conflict of interest. <br /> <br />Staff Presentation of Facts and Issues: <br />McCartney summarized the staff report with the following points: <br />. A variance request to allow for an existing driveway to remain in place <br />following the construction of a single-car garage that will acquire access off <br />the rear alley. <br />. Staff has received no public comments on the variance application. <br />. A review of the six variance criteria resulted in staff finding all six criteria had <br />been met. <br />. Staff recommends approval without conditions. <br /> <br />Questions of Staff bv the Board and Applicant: <br />Weise inquired if the current driveway would be modified or stay as is. <br /> <br />McCartney stated it was his understanding the driveway would stay as is. <br /> <br />Chancellor, Stuart and Malmquist discussed Criteria #2 (unusual circumstances) and <br />whether the application actual meets that criterion. <br /> <br />Stuart summarized by stating that driveways do not exist throughout the neighborhood <br />thus the criterion has been met. <br /> <br />Applicant Presentation: <br />Diane Volk, property owner, stated she had no formal presentation but would answer <br />the Boards questions. <br /> <br />Questions of Applicant bv Board and Staff: <br />Chancellor, Malmquist and Weise asked Volk to discuss the parking situation on her <br />street. <br /> <br />Volk stated the parking is solid, especially with any special events in downtown and with <br />the addition of some teenage drivers in the family she is interested in maintaining those <br />off-street parking spaces. <br /> <br />Malmquist asked if Volk had gotten a cost estimate for removing the concrete and <br />replacing the curb cut. <br />
