as may be reasonably necessary to cause the proper maintenance of the Leased Property in the <br />event of failure by the City to perform its obligations under this Lease. <br />ARTICLE IV <br />LEASE TERM <br />Section 4.01. Duration of Lease Term; City's Annual Right to Renew Lease. The <br />Lease Term shall commence as of the date hereof and continue through the last day of the <br />current Fiscal Year of the City. Subject to the provisions of Section 4.02 hereof, the Lease <br />Term may be renewed at the end of the Original Term and at the end of each renewal term <br />thereafter for a term of twelve months coinciding with the next succeeding Fiscal Year of the <br />City. The City shall have the right to annually renew the Lease Term unless (a) the City gives <br />written notice to Alpine Bank not less than 30 days prior to the end of the Original Term or the <br />then current Renewal Term of the City's intention not to renew this Lease at the end of the <br />Original Term or the then current Renewal Term, or (b) an Event of Nonappropriation shall <br />have occurred with respect to a Renewal Term occurring after the Original Term or any then <br />current Renewal Term. The terms and conditions during any Renewal Term shall be the same <br />as the terms and conditions during the Original Term, except for the amount of Base Rentals <br />and Additional Rentals to be paid during such Renewal Tenn. The Lease Term, including the <br />Original Term and all Renewal Terms, does not exceed the weighted average useful life of the <br />Leased Property or the Financed Project. <br />Except as otherwise provided in Section 4.02 hereof, the exercise of the City's annual <br />option to renew this Lease shall be conclusively determined by whether or not the Council has, <br />on or before the last day of each Fiscal Year, duly enacted an appropriation resolution or <br />ordinance for the ensuing Fiscal Year which includes (a) by specific line item reference <br />sufficient amounts authorized and directed to be used to pay all the Base Rentals and (b) <br />sufficient amounts to pay such Additional Rentals as are estimated to become due, all as further <br />provided in Section 6.06 of this Lease. The officer of the City at any time charged with the <br />responsibility of formulating budget proposals is hereby directed to include in the annual budget <br />proposals submitted to the Council, items for all payments required under this Lease for the <br />ensuing Fiscal Year, until such time (if any) as the Council may determine to renew or not to <br />renew this Lease; it being the intention of the Council that any decision to renew or not to renew <br />this Lease and make or not make appropriations therefore in any Fiscal Year shall be made solely <br />by the Council and not by any other official of the City. Said officer shall also include in said <br />budget proposal the total amount to be expended by the City during the ensuing Fiscal Year for <br />payment obligations under all lease - purchase agreements involving real property, including this <br />Lease; the total maximum payment liability of the City under all lease- purchase agreements <br />involving real property, including this Lease, over the entire terms of such agreements, including <br />all optional renewal terms; the total amount to be expended by the City during the ensuing Fiscal <br />Year for payment obligations under all lease - purchase agreements other than those involving real <br />property; and the total maximum payment liability of the City under all lease- purchase <br />agreements other than those involving real property, over the entire term of such agreements, <br />including all optional renewal terms. Each budget required by law to be filed with the State <br />Department of Local Affairs, Division of Local Government, shall include a supplemental <br />schedule that contains the foregoing information.
