(e) Alpine Bank may take possession of all credits, monies, funds or accounts <br />held pursuant to the CEC Agreements and apply the same to reduce the Remaining Lease <br />Balance and any other amounts owing under this Lease. <br />(f) Alpine Bank may take whatever action at law or in equity may appear <br />necessary or desirable to enforce its rights in and to the Leased Property under this Lease. <br />Section 13.03. Limitations on Remedies. A judgment requiring a payment of money <br />may be entered against the City by reason of an Event of Default only as to the City's liabilities <br />described in paragraph (d) of Section 13.02 of this Lease. A judgment requiring a payment of <br />money may be entered against the City by reason of an Event of Nonappropriation only to the <br />extent that the City fails to vacate and surrender possession of the Leased Property as required <br />by Section 6.06 of this Lease, and only as to the liabilities described in paragraph (d)(i) of <br />Section 13.02 of this Lease. The remedy described in paragraph (d)(ii) of Section 13.02 of this <br />Lease is not available for an Event of Default consisting of failure by the City to vacate and <br />surrender possession of the Leased Property within ten Business Days following notice of an <br />Event of Nonappropriation. <br />Section 13.04. No Remedy Exclusive. Subject to Section 13.03 hereof, no remedy <br />herein conferred upon or reserved to Alpine Bank is intended to be exclusive, and every such <br />remedy shall be cumulative and shall be in addition to every other remedy given hereunder or <br />now or hereafter existing at law or in equity. No delay or omission to exercise any right or <br />power accruing upon any default shall impair any such right or power or shall be construed to <br />be a waiver thereof, but any such right and power may be exercised from time to time and as <br />often as may be deemed expedient. In order to entitle Alpine Bank to exercise any remedy <br />reserved in this Article XIII, it shall not be necessary to give any notice, other than such notice <br />as may be required in this Article XIV. <br />Section 13.05. Waivers. Alpine Bank may waive any Event of Default under this <br />Lease and its consequences. In the event that any agreement contained herein should be <br />breached by either party and thereafter waived by the other party, such waiver shall be limited <br />to the particular breach so waived and shall not be deemed to waive any other breach <br />hereunder. <br />Section 13.06. Agreement to Pay Attorneys' Fees and Expenses. To the extent <br />permitted by law and subject to the provisions of Section 6.01 hereof, in the event that either <br />party hereto shall default under any of the provisions hereof and the nondefaulting party shall <br />employ attorneys or incur other expenses for the collection of Base Rentals and Additional <br />Rentals, or the enforcement of performance or observance of any obligation or agreement on <br />the part of the defaulting party herein contained, the defaulting party agrees that it shall on <br />demand therefor pay to the nondefaulting party the fees of such attorneys and such other <br />expenses so incurred by the nondefaulting party, to the extent that such attorneys' fees and <br />expenses may be determined to be reasonable by a court of competent jurisdiction. <br />24 <br />4812 - 2161 -1294 9 <br />
