RESOLUTION NO. 42 <br />SERIES 2015 <br />A RESOLUTION APPROVING THE COMMUNITY DEVELOPMENT BLOCK GRANT <br />— DISASTER RECOVERY INFRASTRUCTURE GRANT AGREEMENT FOR THE <br />COUNTY ROAD BRIDGE <br />WHEREAS, the Department of Housing and Urban Development ( "HUD ") Community <br />Development Block Grant Disaster Recovery ( "CDBG -DR ") Program has appropriated funds for <br />disaster assistance and is distributing appropriated funds to the State of Colorado; and <br />WHEREAS, the City of Louisville, desires to participate in such CDBG -DR Program <br />funding for the purpose of completing an infrastructure project for repairs to the County Road <br />Bridge damaged by the September 2013 flood; and <br />WHEREAS, the City has determined that it will be mutually beneficial and in the public <br />interest to enter into an Conununity Development Block Grant — Disaster Recovery Infrastructure <br />Grant Agreement with the State of Colorado Department of Local and Affairs ( "the Agreement ") <br />in order to accept CDBG -DR Program funding to replace and upgrade the damaged County Road <br />Bridge; and <br />WHEREAS, the City is authorized to enter into cooperative agreements or contracts <br />pursuant to the Colorado Constitution, Article XIV § 18, and § 29 -1 -203, C.R.S. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br />1. The Community Development Block Grant — Disaster Recovery Infrastructure Grant <br />Agreement between the City of Louisville and the State of Colorado, Department of Local Affairs <br />(the "Agreement "), is hereby approved in essentially the same form as the copy of such Agreement <br />accompanying this Resolution. <br />2. The Mayor is authorized to execute the Agreement on behalf of the City, except that <br />the Mayor is hereby further granted authority to negotiate and approve such revisions to said <br />Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long <br />as the essential terms and conditions of the Agreement are not altered. <br />3. The Mayor, City Manager, City Clerk and City staff are hereby authorized to <br />execute all documents and do all other things necessary on behalf of the City to effect the <br />provisions of the Agreement and perform the obligations of the City under the Agreement, <br />including but not limited to execution and delivery of all certifications, reports, forms, option <br />letters, contract amendments and other documents appropriate or required in connection with the <br />Agreement and completion of the scope of work to be funded through the Agreement. <br />Resolution No. 42, Series 2015 <br />Page 1 of 2 <br />
