RESOLUTION NO. 42 SERIES 2015 A RESOLUTION APPROVING THE COMMUNITY DEVELOPMENT BLOCK GRANT — DISASTER RECOVERY INFRASTRUCTURE GRANT AGREEMENT FOR THE COUNTY ROAD BRIDGE WHEREAS, the Department of Housing and Urban Development ( "HUD ") Community Development Block Grant Disaster Recovery ( "CDBG -DR ") Program has appropriated funds for disaster assistance and is distributing appropriated funds to the State of Colorado; and WHEREAS, the City of Louisville, desires to participate in such CDBG -DR Program funding for the purpose of completing an infrastructure project for repairs to the County Road Bridge damaged by the September 2013 flood; and WHEREAS, the City has determined that it will be mutually beneficial and in the public interest to enter into an Conununity Development Block Grant — Disaster Recovery Infrastructure Grant Agreement with the State of Colorado Department of Local and Affairs ( "the Agreement ") in order to accept CDBG -DR Program funding to replace and upgrade the damaged County Road Bridge; and WHEREAS, the City is authorized to enter into cooperative agreements or contracts pursuant to the Colorado Constitution, Article XIV § 18, and § 29 -1 -203, C.R.S. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: 1. The Community Development Block Grant — Disaster Recovery Infrastructure Grant Agreement between the City of Louisville and the State of Colorado, Department of Local Affairs (the "Agreement "), is hereby approved in essentially the same form as the copy of such Agreement accompanying this Resolution. 2. The Mayor is authorized to execute the Agreement on behalf of the City, except that the Mayor is hereby further granted authority to negotiate and approve such revisions to said Agreement as the Mayor determines are necessary or desirable for the protection of the City, so long as the essential terms and conditions of the Agreement are not altered. 3. The Mayor, City Manager, City Clerk and City staff are hereby authorized to execute all documents and do all other things necessary on behalf of the City to effect the provisions of the Agreement and perform the obligations of the City under the Agreement, including but not limited to execution and delivery of all certifications, reports, forms, option letters, contract amendments and other documents appropriate or required in connection with the Agreement and completion of the scope of work to be funded through the Agreement.
