RESOLUTION NO. 45 <br />SERIES 2015 <br />A RESOLUTION APPROVING A PRELIMINARY SUBDIVISION PLAT AND <br />PRELIMINARY PLANNED UNIT DEVELOPMENT (PUD) FOR 245 NORTH 96TH <br />STREET TO ALLOW THE DEVELOPMENT 231 RESIDENTIAL UNITS AND 18,406 <br />SQUARE FEET OF COMMERCIAL DEVELOPMENT <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a Preliminary Subdivision Plat and Preliminary Planned Unit <br />Development (PUD) for 245 North 96th Street to allow for a 231 residential units and <br />18,406 Square feet of commercial development; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with the LMC Sec. 16.12.030, Sec. 17.28.170; and Sec. 17.40.100. <br />WHEREAS, after a duly noticed public hearing on July 14, 2015 where evidence <br />and testimony were entered into the record, including the findings in the Louisville City <br />Council Staff Report dated July 14, 2015, the City_. Council finds the Preliminary <br />Subdivision Plat and Preliminary Planned Unit. Development (PUD) for 245 North 96 <br />Street should be approved with five conditions noted below; <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby approves a Preliminary Subdivision Plat and Preliminary Planned <br />Unit Development (PUD) for 245 North 96th Street with the following conditions: <br />1. The applicant shall provide an emergency access plan using the Fire District <br />apparatus dimensions as part of the final Plat and PUD submittal. The <br />emergency access plan shall demonstrate all corners are navigable before the <br />City of Louisville and the Louisville Fire Protection District give final approval to <br />the requested street sections. <br />2. The public land dedication recommendation for the property shall be resolved <br />between City staff and the applicant prior to the submittal of the Final Plat. <br />3. The applicant shall provide as part of the Final PUD application an executed <br />easement use agreement between the City of Lafayette and BCHA allowing the <br />County to construct surface improvements proposed on the City of Lafayette's <br />utility easement. <br />4. The applicant shall provide as part of the Final PUD application an executed <br />agreement between the Goodhue Ditch Company and BCHA. <br />Resolution No. 45, Series 2015 <br />Page 1 of 2 <br />
