4. The applicant shall comply with the PUD /Plat comments listed in the Public <br />Works memo dated February 5, 2015 prior to City Council, and <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission and finds that said final plat, special <br />review use, and final PUD development plan should be approved, subject to the <br />conditions listed below; <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado, based on the evidence and testimony presented at the hearing, <br />does hereby approve a final subdivision plat, special review use (SRU) and a final <br />planned unit development (PUD) to develop phase 2 of a redevelopment project within <br />the core project area of the HWY 42 framework plan. The project includes a diversity of <br />housing products, civic spaces, urban plazas, streetscapes and commercial <br />opportunities, formally known as DELO, with the following conditions: <br />1. The applicant shall continue to work with City staff to clarify the PUD and plat <br />notes regarding the Developer /Successor HOA's obligations for the maintenance <br />of open space and roadways. Final details regarding maintenance obligations <br />will be included in the Subdivision Improvement Agreement. <br />2. If an offsite solution cannot be found, the detention basin and public gathering <br />space, as depicted in DELO Phase 1 and 1A, shall be located in Outlot B, Outlot <br />C and within the E. Lafayette Street right of way. The basin should be designed <br />to provide stairs, stepping down from Cannon Street through the proposed <br />retaining walls, to make this space more publically interactive. The stairs should <br />be a minimum width of 50 feet along Canon Street, or a mutually support design <br />alternative that is open and accessible. <br />3. Should a regional offsite detention basin be created to detain the drainage of the <br />Highway 42 development (including DELO Phase 1/1A and Phase 2), the <br />applicant shall develop Nawatny Greenway as depicted in DELO Phase 2 PUD. <br />4. The applicant shall comply with the PUD /Plat comments listed in the Public <br />Works memo dated February 5, 2015 prior to recording of the PUD and Plat. <br />5. Subdivider shall, at its expense, obtain and convey or cause to be conveyed to <br />the City the full right -of -way for the Cannon Street extension from Short Street to <br />South Street. Such conveyance to the City shall be made prior to recording of <br />the plat and PUD, free and clear of liens and encumbrances, except those <br />acceptable to the City. <br />6. Subdivider shall, at its expense, obtain and convey or cause to be conveyed to <br />the City all easements over or fee title in the Comcast property for the Nawatny <br />Greenway. Such conveyance to the City shall be made prior to the recording of <br />the plat and PUD, free and clear of liens and encumbrances, except those <br />acceptable to the City. <br />Resolution No. 14 , Series 2015 <br />Page 2 of 3 <br />
