RESOLUTION NO. 51 <br />SERIES 2015 <br />A RESOLUTION APPROVING AN AMENDMENT TO THE GATEWAY FINAL <br />PLANNED UNIT DEVELOPMENT (PUD) TO MODIFY THE HEIGHT ALLOWANCE <br />LANGUAGE ON LOT 1, BLOCK 1 FROM "1 STORY WITH A 26 FEET MAXIMUM <br />BUILDING HEIGHT" TO "1 OR 2 STORIES WITH A MAXIMUM BUILDING HEIGHT <br />OF 26 FEET, WHERE THE SECOND STORY WOULD ONLY BE ALLOWED IF THE <br />FOLLOWING CONDITIONS ARE MET: <br />1. THE PROPOSED PRINCIPAL STRUCTURE MAINTAINS A MINIMUM 3:12 <br />ROOF PITCH; AND, <br />2. THE PROPOSED LOT COVERAGE SHALL NOT EXCEED 8.5 %" <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application requesting an amendment to the Gateway PUD to allow two -story residential <br />units on Lot 1 on Block 1 of the Gateway Subdivision without changing the existing 26- <br />foot height limitation; and <br />WHEREAS, the City Staff has reviewed the PUD amendment application and <br />found it to comply with Louisville zoning regulations and would not alter the intended <br />goal of the previous restriction in maximizing the City's view of the Flatirons from <br />McCaslin Boulevard, or the views of the Flatirons from adjacent properties; and <br />WHEREAS, after a duly noticed public hearing on July 9, 2015, where evidence <br />and testimony were entered into the record, including the findings in the Louisville <br />Planning Commission Staff Report dated June 9, 2015, the Planning Commission <br />recommends approval of the PUD Amendment to the City Council. <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission, and finds that it complies with Chapter <br />17, Section 17.28 of the Louisville Municipal Code, and other applicable requirements. <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Louisville, <br />Colorado does hereby recommend approval Resolution 51, Series 2015, a resolution <br />approving an amendment to the Gateway Final Planned Unit Development (PUD) to <br />modify the height allowance language on Lot 1, Block 1 from "1 story with a 26 feet <br />maximum building height" to "1 or 2 stories with a maximum building height of 26 feet, <br />where the second story would only be allowed if the following conditions are met: <br />1. The proposed principal structure maintains a minimum 3:12 roof pitch; and, <br />2. The proposed lot coverage shall not exceed 8.5% <br />Resolution No. 51, Series 2015 <br />Page 1 of 2 <br />
