Boulder County, CO 03498403 4 of 6 <br />AMENDMENT TO ADDENDUM TO ANNEXATION AGREEMENT <br />(Gateway Annexation) <br />THIS AMENDME TO ADDENDUM TO ANNEXATION AGREEMENT is made <br />and entered into this .28 day of , 2015, by and between TIERA CHRISTINA <br />NELL and JEREMY LANCE WEISS, whose address is 2287 South Columbine Street, Denver, CO <br />80210 and the C1TY OF LOUISVILLE, a home rule municipal corporation of the State of Colorado <br />( "City ") with reference to that certain ADDENDUM TO ANNEXATION AGREEMENT by and <br />between Louisview Corporation and City which is dated December 5, 1995 and was recorded on <br />March 4, 1996 as Reception No. 01588413 in the Office of the Boulder County Clerk and <br />Recorder and is hereinafter referred to as the "Addendum" and that certain ANNEXATION <br />AGREEMENT by and between Louisview Corporation and the City which is dated December 5, <br />1995 and was recorded on March 4, 1996 as Reception No. 01588412 in the Office of the <br />Boulder County Clerk and Recorder and is hereinafter referred to as the "Annexation <br />Agreement;" and <br />WHEREAS, the Owners are the owners of Lot 1, Block 1, Gateway PUD, a/k/a Copper <br />Hill Community Interest Community, Assessor Parcel Nos. 157507226001; and <br />WHEREAS, the Addendum includes a provision requiring the dwellings on Lot 1 be one <br />story and no more than twenty -six feet in height; and <br />WHEREAS, the Owners and City desire to amend the Addendum to allow two story <br />dwellings on Lot 1 without changing the existing twenty -six foot height limitation, where the <br />second story would only be allowed if the following conditions are met: <br />1. The proposed principal structure maintains a minimum 3:12 roof pitch; and, <br />2. The proposed lot coverage shall not exceed 8.5 %. <br />NOW, THEREFORE, in consideration of the recitals, promises, covenants and <br />undertakings hereinafter set forth, and other good and valuable consideration, the sufficiency of <br />which is hereby acknowledged and confessed, the Owners and City agree as follows: <br />1. Section 14 of the Addendum is hereby amended to read as follows (words to be <br />added are underlined; words deleted are stnckelithrough): <br />14. No more than one twe single family dwellings may be constructed <br />on the portion of the property located on the west side of McCaslin Boulevard, Lot <br />1, Block 1, Gateway PUD, a/k/a Copper Hill Community Interest Community, <br />Assessor Parcel No. 157507226001 Pars No. 4 and No. 5 on the approved <br />And. Such dwelling shall be single or two story, but in no event shall <br />such dwellings be afid-iiet more than twenty -six (26) feet in height.
