user's initiation of the changes. Grease, oil, and sand interceptors shall be
<br />provided when, in the opinion of the city, they are necessary for the proper
<br />handling of wastewater containing excessive amounts of grease and oil, or sand;
<br />except that such interceptors shall not be required for residential users. All
<br />interception units shall be of type and capacity approved by the city and shall be
<br />so located to be easily accessible for cleaning and inspection. Such interceptors
<br />shall be inspected, cleaned, and repaired by the user at the user's expense. Grease
<br />interceptors shall be cleaned as often as necessary to ensure that sediment and
<br />floating materials do not accumulate to impair the efficiency of the _ grease
<br />interceptor; that the discharge is in compliance with local wastewater discharge
<br />limits; and, to ensure that no visible grease is observed in the discharge. Grease
<br />interceptors shall be completely evacuated at a minimum of every ninety (90)
<br />days, or more frequently when: i) Twenty -five percent 125%)_ or more of the
<br />wetted height of the grease trap or grease interceptor, as measured from the
<br />bottom of the device to the invert of the outlet pipe, contains floating materials,,
<br />sediment, oils or greases; ii) The discharge exceeds BOD, COD, TSS, FOG, pH,
<br />or other pollutant levels established by the director of public works; or, iii) If
<br />there is a history of noncompliance.
<br />Section 6. If any portion of this ordinance is held to be invalid for any reason, such
<br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council
<br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact
<br />that any one part be declared invalid.
<br />Section 7. The repeal or modification of any provision of the Municipal Code of the
<br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole
<br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred
<br />under such provision, and each provision shall be treated and held as still remaining in force for the
<br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the
<br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any
<br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits,
<br />proceedings, or prosecutions. Nothing in this ordinance is intended or shall be construed to create
<br />any right to any rebate, refund, credit or abatement of any amounts paid or owning to the City.
<br />Section 8. All other ordinances or portions thereof inconsistent or conflicting with this
<br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
