RESOLUTION NO. 47 <br />SERIES 2015 <br />A RESOLUTION APPROVING A FINAL PLANNED UNIT DEVELOPMENT (PUD) <br />PLAN FOR A NEW 12,772 SQUARE FOOT, SINGLE STORY BUILDING WITH <br />RETAIL AND RESTAURANT SPACE AT 994 W. DILLON ROAD. <br />WHEREAS, there has been submitted to the Louisville City Council an <br />application for approval of a request for a Final Planned Unit Development (PUD) Plan <br />for a new 12,772 square foot, single story building with retail and restaurant space at <br />994 W. Dillon Road; and <br />WHEREAS, the City Staff has reviewed the information submitted and found it to <br />comply with Louisville Municipal Code Chapter 17.28; and <br />WHEREAS, after a duly noticed public hearing on June 11, 2015, where <br />evidence and testimony were entered into the record, including the findings in the <br />Louisville Planning Commission Staff Report dated June 11, 2015, the Planning <br />Commission forwarded a recommendation of approval of the proposed Final PUD Plan, <br />with the following condition: <br />1. With regard to trees to be removed and trees to remain, the applicant shall work <br />with the City Forester to find balance between site visibility and maintaining tree <br />rows along major corridors in the City. <br />WHEREAS, City Council has reviewed the application, including the <br />recommendation of the Planning Commission, and finds that the application complies <br />w. ith Chapter 17.28 of the Louisville Municipal Code; <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of <br />Louisville, Colorado does hereby approve a Final Planned Unit Development (PUD) <br />Plan for a new 12,772 square foot, single story building with retail and restaurant space <br />at 994 W. Dillon Road, with the following conditions: <br />1. With regard to trees to be removed and trees to remain, the applicant shall work <br />with the City Forester to find balance between site visibility and maintaining tree <br />rows along major corridors in the City. <br />2. Add a note to the PUD stating the City shall have the right to require a shared <br />parking agreement when a use generating a parking ratio in excess of 7 spaces <br />per 1,000 SF is proposed to be sited within the development, causing aggregate <br />parking demand for all uses to exceed 91 parking spaces. <br />Resolution No. 47, Series 2015 <br />Page 1 of 1 <br />
