City Council <br />Meeting Minutes <br />August 4, 2015 <br />Page 10 of 11 <br />The Mayor requested the City Council Convene an Executive Session for the <br />Purpose of Conducting an Annual Performance Review of the City Manager <br />REGULAR BUSINESS ITEMS SUSPENDED <br />City Clerk Varra read Section 2.90.050 public statement from the Louisville Municipal <br />Code, which governs the topics that may be discussed in an executive session. <br />City Attorney Light stated the authority for conducting an executive session is the <br />Louisville Code of Ethics, Section 5 -2(b), CRS 24- 6- 402(4)(f) - Authorized Topics. The <br />City Manager has not requested discussion of the matter in open session and the <br />discussion does not concern any member of the City Council or any elected official, or <br />the appointment of any persons to fill an office on City Council, nor does it involve <br />personnel policies that do not require the discussion of matters personal to particular <br />employees. City Attorney Light reported receiving confirmation from the City Manager <br />that he is not requesting discussion of the matter in an open meeting. <br />MOTION: Mayor Muckle moved the City Council convene an executive session for the <br />purpose of the performance review of the City Manager and the executive session <br />include members of the City Council and the City Attorney, seconded by Mayor Pro <br />Tem Dalton. All were in favor. <br />Council member Leh explained the public is sometimes confused by the reason for City <br />Council executive sessions. He requested an explanation be given to clarify the reason <br />for this executive session. <br />Mayor Muckle explained the City Council is required, at least once annually, to review <br />the performance of the City Manager. Personnel matters are discussed in confidence <br />and not in a public meeting, unless the employee wishes otherwise. The City Council <br />will enter into an executive session to discuss the City Manager's annual review. <br />The Council adjourned to executive session at 8:15 p.m. The regular meeting was <br />reconvened at 10:50 p.m. <br />REGULAR BUSINESS ITEMS CONTINUED <br />CITY ATTORNEY REPORT ON THE EXECUTIVE SESSION <br />Mayor Muckle reported in executive session, the City Council discussed the annual <br />performance of the City Manager and provided input to the City Attorney, who would <br />provide a summary of the discussion for the annual review, which will then be shared <br />with the City Manager. <br />
