City Council <br />Meeting Minutes <br />July 28, 2015 <br />Page 13 of 28 <br />TO "1 OR 2 STORIES WITH A MAXIUM BUILDING HEIGHT OF 26 FEET ", <br />WHERE THE SECOND STORY WOULD ONLY BE ALLOWED IF THE <br />FOLLOWING CONDITIONS ARE MET <br />1. THE PROPOSED PRINCIPAL STRUCTURE MAINTAINS A MINIMUM <br />3:12 ROOF PITCH; AND, <br />2. THE PROPOSED LOT COVERAGE SHALL NOT EXCEED 8.5% <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No. 1694, Series 2015 and the accompanying <br />resolutions. He noted this item came before Council a few months ago. He stated the <br />presentation should include all items and the public may speak on any of the three <br />agenda items. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Planning and Building Safety Director Russ explained the applicant, Vern Seieroe, has <br />returned to the City requesting approval of a Planned Unit Development (PUD) <br />Amendment to the Gateway Final Planned Unit Development (PUD) to modify the <br />height allowance language on Lot 1, Block 1 from "1 story with a 26 feet maximum <br />building height" to "1 or 2 stories with a maximum building height of 26 feet, where the <br />second story would only be allowed if the following conditions are met: <br />1. The proposed principal structure maintains a minimum 3:12 roof pitch; and, <br />2. The proposed lot coverage shall not exceed 8.5 %." <br />This is the applicant's second attempt to amend the PUD to allow a 2nd story within the <br />26 -foot height allowance. City Council denied the applicant's initial request by denying <br />Ordinance 1687, Series 2015 and an amendment to an addendum to an Annexation <br />Agreement. <br />The City Council denied the initial amendment request because they felt the request for <br />a 2^° story within the existing 26 -foot height allowance without a minimum roof pitch or <br />corresponding maximum lot coverage reduction, would negatively impact the City's view <br />shed of the Rocky Mountains from McCaslin Boulevard. <br />Staff Recommendation: Staff recommended approval of Ordinance No. 1694, Series <br />2015 and Resolutions Nos. 50 and 51, Series 2015. <br />PUBLIC COMMENT <br />Phillip Prine, 1091 Copper Hill Court, Louisville, CO, a Gateway HOA member <br />explained this is one of two remaining properties in the development.
