City Council <br />Meeting Minutes <br />July 28, 2015 <br />Page 23 of 28 <br />Council member Stolzmann asked if staff could investigate whether the City owns a <br />small tract between the RV dump and Empire Road, which could be used for access. <br />Mayor Muckle encouraged staff to investigate different access points to the property. <br />COUNCIL DIRECTION: Council directed staff to continue and finalize negotiations with <br />the Human Movement Management and make an effort to see if the snorkel property <br />would work for RV /boat storage, with a review and re- evaluation after the initial 15 -year <br />lease. <br />ORDINANCE No. 1697,SERIES 2015 — AN ORDINANCE AMENDING SECTIONS <br />3.08.030 AND 13.12.020 OF THE LOUISVILLE MUNICIPAL CODE TO ADDRESS <br />WATER SERVICE CONNECTIONS AND WATER TAP FEES FOR LIVE -WORK LAND <br />USES —2nd Reading - Public Hearing <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No. 1697, Series 2015. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Planning and Building Safety Director Russ explained on June 2, 2015, City Council <br />approved Ordinance 1691, Series 2015, an Ordinance defining Live -Work and allowing <br />the live -work use to occur in the downtown Louisville and mixed use districts. Live - <br />Work properties are not allowed to sub - divide and shall remain under a single <br />ownership. The LMC does not prohibit the renting of either the residential or commercial <br />portions of Live -Work units. Commercial land uses will be limited to those allowed in the <br />MUR and CC Zone Districts. <br />Staff has identified needed LMC amendments to ensure the City's water ordinance <br />(Title 13) reflects the operating characteristics of the Live -Work land use category and <br />present an equitable fee structure ensuring applicants are charged fairly for City water <br />services. The proposed changes to Title 13 recognize live -work land uses are defined <br />as a single property with one or more structures that combine a commercial activity <br />allowed by -right in the underlying zone district with a single residential living unit. Live <br />work units are expected to be small in scale and present unique water demand not <br />currently recognized in the LMC. Modifications to Sections 13.08.030, 13.12.020 and <br />13.12.040 of the LMC would address water service connections and water tap fees for <br />live -work uses. There will be no new customer class and there will be one tap for the <br />two sub - meters to monitor the water flows. The on -going charges would reflect the <br />commercial use would be charged the commercial rate and the residential use would be <br />charged the residential rates. <br />Staff Recommendation: Staff recommended City Council approve Ordinance No. 1697, <br />Series 2015, amending Sections 13.08.030, 13.12.020 and 13.12.040 of the Louisville <br />
