City Council <br />Meeting Minutes <br />July 28, 2015 <br />Page 25 of 28 <br />Mayor Muckle agreed and stated he did not see how money is being saved. He felt the <br />water is extremely valuable. Mayor Pro Tem Dalton agreed. <br />Council member Loo inquired whether this should be referred back to the Water <br />Committee. Council member Lipton stated the water committee looked at this matter, <br />but did not consider Council member Stolzmann's comments and suggestions. The <br />Committee did not want to overcharge the water tap or to be punitive. He supported the <br />Water Committee revisiting this matter. <br />Council member Stolzmann suggested an alternative proposal to deny the ordinance <br />and continue to access a business tap and a residential tap. She did not support the <br />ordinance based on a very small sample size and involving very few properties. <br />Council member Lipton disagreed and stated the proposal may change, and he <br />preferred continuing the ordinance. <br />MOTION: Council member Lipton moved to continue Ordinance No.1697, Series 2015 <br />to September 15th to allow the water committee to review this matter and make a <br />recommendation to the City Council, seconded by Mayor Muckle. <br />Council member Stolzmann felt the staff has very limited time and this ordinance affects <br />very few people. She opposed the motion to continue the ordinance. <br />VOTE: The motion carried by a vote of 4 -2. Mayor Pro Tem Dalton and Council <br />member Stolzmann voted no. Absent: Council member Keany. <br />ORDINANCE No. 1699, SERIES 2015 — AN ORDINANCE APPROVING THE <br />VACATION OF A .002 ACRE PORTION OF THE 50 -FOOT WIDE UNIMPROVED <br />SHORT STREET RIGHT -OF -WAY DEDICATED TO THE CITY BY THE PLAT OF <br />INDUSTRIAL AREA SUBDIVISION IN THE CITY OF LOUISVILLE - 2nd Reading - <br />Public Hearing <br />Mayor Muckle requested a City Attorney introduction. <br />City Attorney Light introduced Ordinance No. 1699, Series 2015. <br />Mayor Muckle opened the public hearing and requested a staff presentation. <br />Planning and Building Safety Director Russ explained the Council approved DELO <br />Phase 2 on March 17, 2015. The approved development included the vacation of two <br />remnant portions of East Lafayette right -of- way. The applicant requested a third <br />vacation of remnant right -of -way in the original development request. This portion of <br />right -of -way is located on a westem portion of Short Street (on the west side of Cannon <br />Street) and amounts to about .002 acres. The City does not need this remnant piece of <br />
