I'm saying
that the parties cooperation is part
of the agreement and if that
cooperation were not forthcoming, I
think the agreement does provide for
other parties to seek specific
performance.

From what you said before, the
Courts, generally, want to enforce
agreements as enforceable entities.
Annette, a gentleman said that no
one from the City has tried to go to
the owners of the property or their
designates to see about acquiring
the land for the City's benefit.

No one from the City has approached
the Lastoka owners regarding this
land. The overtures were made by
Boulder County. The offer was made
by Boulder County. A counter offer
was made by the Lastokas to Boulder
County. All of our contact has been
with Boulder County. I've never
been directed to do that.

Since the City has not really
determined whether or not we could
purchase this land for any purpose,
I have to ask why not? Is Council
at all interested? Would Council be
willing to consider the purchase of
this property?

I would like to see an inquiry made
as to whether the proposed agreement
with the Lastokas would be something
that could be transferred to the
City of Louisville and whether we
have the monies to execute the
agreement. It seems to me that the
agreement has a 15 year life,
meaning that the agreement would
expire late 1999. Given that, I
want to see the parcel as open
space, but, also, see the City of
Louisville have the control of the
property, which has been within
Louisville's domain for many years.
I don't want to see us do anything

15
