Mayer: <br /> <br />Is it clear that the proposed <br />pipeline is not going to go through <br />the Coal Creek Golf Course? <br /> <br />Tom Phare, Director of Public Works, stated that from the <br />discussion with the District, getting from the terminal point of <br />the pipeline to Louisville and/or Superior through partial joint <br />facilities and part independent facilities is yet to be 100% <br />determined and agreed upon. The District has the obligation, <br />should Superior ask them to, to get from where ever the pipeline <br />ends, on what ever route is chosen, over to their place, with or <br />without Louisville in the project. <br /> <br />Mayer: <br /> <br />Are there any restrictions in the <br />way we take water? <br /> <br />Dreher: <br /> <br />Mayer: <br /> <br />You would have a contractual right <br />to the 3.0 C.F.S. at any time, any <br />day, providing the pipeline is <br />operational. This does not tie you <br />to any particular water supply. <br /> <br />When the allotment contract is <br />talked about, it's really the C.F.S. <br />and the pipeline and not the .... ? <br /> <br />Dreher: <br /> <br />That's correct. In the end you will <br />have to consider three (3) allotment <br />contracts. This first one is the <br />pipeline allotment of capacity. <br />Then, there would be an allotment <br />contract for ownership of CBT water, <br />if you chose to own CBT. Then, the <br />allotment of Windy Gap, if you chose <br />to own Windy Gap. <br /> <br />Mayer wondered at what point and at what increments could <br />Louisville increase their C.F.S. <br /> <br />Dreher: <br /> <br />In terms of the timing, the last <br />date that you could get additional <br />capacity with certainty is March 15. <br />Beginning after the middle of March <br />we will be drawing production. At <br />that point, to change the capacity <br />would involve going back and redoing <br />some design. That may still be <br />possible, but if we were to do that, <br />you would have to incur the full <br />cost of the redesign. By May 1, <br />even if you were willing to pay the <br />redesign costs, there probably is <br /> <br />7 <br /> <br /> <br />
